NON-EMERGENCY EVENT NOTIFICATION, 10 CFR 50.72, SALEM NUCLEAR GENERATING STATION, UNITS 1 AND 2, AND HOPE CREEK GENERATING STATION

{TAC NOS. M84449, M84450, AND M84451}

In a letter dated September 2, 1992, Public Service Electric and Gas {PSE&G}

requested relief from the 4-hour notification requirements in 10 CFR 50.72{b}{2}{vi).

PSE&G is currently making 4-hour notifications of minor non-radioactive chemical spills which PSE&G must report to the New Jersey Department of Environmental Protection and Energy {DEPE} pursuant to DEPE rules. According to data provided by PSE&G in an attachment to their September 2, 1992 letter, these spills varied between 1 pint to 50 gallons between January through August 1992, and are not reportable to the Environmental Protection Agency {EPA} under the Comprehensive Environmental Response, Compensation and Liability Act (CERCLA}.

PSE&G argues that the notification requirements of Section 50.72(b}(2}{vi} were not intended to require reporting of minor non-radiological spills. In support of this argument, they cite the discussion in a draft revision to NUREG-1022, which the NRC staff has issued for public comment.

The staff has not previously provided guidance on the reportability of licensee reports to state agencies regarding minor, non-radiological spills.

As PSE&G notes, however, the staff has proposed in the draft revision to NUREG-1022 that required state reports of minor, non-radiological spills need not be reported pursuant to Section 50.72{b}{2}{vi}.

Until a final revision to NUREG-1022 has been issued, the staff's interim view is that such state reports need not be reported to the NRC under Section 50.72{b}{2}{vi}.
