.EN 92-046 NOTIFICATION OF SIGNIFICANT ENFORCEMENT ACTION Licensee:

Public Service Electric & Gas Company (EA 92-084)

EXERCISE OF ENFORCEMENT DISCRETION This is to inform the Commission of the staff's intention to exercise enforcement discretion under Section.VII.B.4 of the Enforcement Policy and refrain from issuing a civil penalty or Notice of Violation for a Severity Level III violation at the Public Service Electric and Gas Company's Salem facility.

The violation involves operation.of Salem Unit 2 in a condition outside the plant design basis as a result of nonconservative assumptions used in the original main steam line break analysis for the auxiliary feedwater system.

Normally, escalated enforcement action would be taken for such a condition because it involved the plant operating outside of its design basis.

However,Section VII. B *. 4 of the Enforcement Policy provides for enforcement discretion for violations involving old design issues where the licensee has proactively identified a violation which would not have otherwise been identified and for which the licensee has taken comprehensive corrective actions.

Although the Enforcement Policy does not require Commission consultation for exercise of enforcement discretion in accordance with Section VII. B. 4, the*. Commission is being advised in this instance due to previous congressional interest associated with NRC enforcement action at Salem.

It should be noted that the licensee has not been specifically informed of this proposed action.

The schedule of. issuing a letter to the licensee notifying them of this NRC decision is three working days from the date of this notification.
