{{#Wiki_filter:* APPENDIX A NOTICE OF VIOLATION Public Service Electric and Gas Company Docket No. 50-272 As a result of the inspection conducted on March 31, 1981, of the shipment of radioactive waste which was shipped from the Salem Nuclear Generating Station on March 25, 1981, and in accordance with the Interim Enforcement Policy, 45 FR 66754 (October 7, 1980), the following violations were identified. A. 10 CFR 71.5 prohibits delivery of licensed material to a carrier for trans-port unless the licensee complies with applicable regulations of the De-partment of Transportation in 49 CFR Parts 170-189. 49 CFR 173.393(n)(3), states, 11 Each closure device {)f the packaging, in-cluding any required gasket, is properly installed and secured and free of defects. 11 Contrary to the above, the bolt to Drum No. 1926, that was supposed to secure the package, was not in the lock ring of the drum as observed by the inspector on March 31, 1981, as the drums were being unloaded. The bolt was lying on the floor of the truck. This is a Severity Level IV Violation. (Supplement V.D.1) B. 10 CFR 71.5 prohibits delivery of licensed material to a carrier for trans-port unless the licensee complies with applicable regulations of the De-partment of Transportation tn 49 CFR Parts 170-189. 49 CFR 177.842(d), states, 11 Packages must be so blocked and-braced that they cannot change position during conditions normally incident to transportation. 11 Contrary to the above, on March 31, 1981, the inspector observed that Drum Number 1900 had moved against the door of the trailer such that on opening the door of the trailer, Drum No. 1900 came out of the trailer and hung suspended by a metal band. This is a Severity Level IV Violation. (Supplement V.D.1) Pursuant to the provisions of 10 CFR 2.201, Public Service Electric and Gas Com-pany is hereby required to submit to this office within thirty days of the date of this Notice, a written statement of explanation in reply, including: (1) the corrective steps which have been taken and the results achieved; (2) corrective steps which will be taken to avoid further violations, and (3) the date when full compliance will be achieved. Under the authority of Section 182 of the Atomic Energy Act of 1954, as amended, this response shall be submitted under oath or affirmation.
