This refers to your letter dated October 10, 1979, in response to our
letter dated August 29, 1979.
Thank you for informing us of the corrective and preventive actions documented
in your letter. These actions will be examined during a subsequent inspection
of your licensed program.
Pursuant to Section 2.201 of the NRC's "Rules of Practice," Part 2, Title
10, Code of Federal Regulations, your response to a Notice of Violation is
required 111ithin twenty (20) days of your receipt of that notice.
We note
that the referenced response does not comply with this requirement. This
matter was discussed between Mr. F. P. Librizzi of your staff and Mr. E. J.
Brunner of this office during a telephone conversation on October 24, 1979
in which we were informed that extenuating* circumstances prevented your
response within the stated period of time.
Also, during this telephone
conversation it was reaffirmed that a response to a Notice of Violation
will be submitted w*ithin the given period of time unless an extension,
based on good cause, is authorized. by this office.
In accordance. with Section 2.790(d) of the NRC's "Rules of Practice,
11 Part
2, Title 10, Code of Federal Regulations, documentation of findings of the
control and. accounting procedures for safeguarding special nuclear materials
and facility security procedures are exempt from disclosure; therefore,
your response letter will not be placed in the Public Document Room.
