APPENDIX A NOTICE OF VIOLATION
__._P-=u=-b l_,_i~c~Se_r_v_ice_Gas-and-E-1-ectr-i-G--Gempany*-------Ducke-t-No~(J-272 Based on the results of an NRC inspection conducted on February 6-9, 1979, it appears that certain of your activities were not conducted in full compliance with NRC regulations and the conditions of your license as indicated below.

A.
10 CFR 50, Appendix B, Criteria!) XVIII, Audits, states, 11A comprehensive system of planned and periodic audits shall be carried out to verify compliance with all aspects of the quality assurance program and to determine the effectiveness of the program.
The audits shall be performed in accordance with the written procedures or check lists by appropriately trained personnel not having direct responsibilities in the areas being audited.
Audit results shall be documented and reviewed by the management having responsibility in the area audited.
Followup action, including reaudit of deficient areas, shall be taken where indicated.
11 The station 1s administrative procedure AP-17, Operational Quality Assurance Program, which implements the system of planned and periodic audits in accordance with written procedures stated the following in the specified paragraphs:
18.6.2 18.7.2 11Applicable elements of the Audit Subjects (in the) quality assurance program shall be audited at least-annually or at least once within the life of the activity, whichever is shorter.
11 11 Freguency of Scheduled Audits Organizations responsible for the operation, maintenance, control or administration of the Salem Station shall be subject to audit under this program not less frequently than that shown in Ref. 2. 19.
11 Ref. 219 Audit Schedule of AP-17 stated that the Station Quality Assurance Engineer (SQAE) establishes and maintains audit schedules imple-mented by OQI-5.

As required during the audit period special audits may be assigned, or the scheduled audit may be shifted on the schedule to be accomplished at another time during the audit period... 11 the target of completion of audits is generally 60 days from the time of initiation.
11 Contrary to this requirement, the periodic audit 11 Radiation Safety and Chemistry, 11 audit subject 11N-l, 11 was not carried out and performed in accordance with the written procedures established, in that the audit is scheduled to be performed at least once per year, but was not performed between April 28, 1977 and February 9, 1979, the time.of this inspection.

10 CFR 71.3, 11Requirement for license, 11 states, 11 No licensee subject to the regulations in this part shall (a) deliver any licensed materials to a carrier for transport or (b) transport licensed material except as authorized in a general license or specific license issued by the Commission or as exempted in this part.
11 Contrary to this requirement, licensed materials were delivered to a carrier for transport without authorization by a general license or specific license issued by the Commission; or without being exempted from this part, on December 13, 1978.
