Docket No. 50-272 Proposed I~suance of Amendment to Facility Operating License No. DPR-70 MOTION FOR EXTENSION OF TIME TO RESPOND TO BOARD QUESTION NO: 4 On July 10, 1979 lTr. 922), the Board requested the parties to respond by.

July 23, 1979, to the following question:

.The Proposed Annex to Appendix D, 10 CFR Part 50, appears to*define a Class 9 accident as a sequence of failures which are more severe than those which the safety features of the plant are designed to prevent.

The sequence of failures at Three Mile Island produced a breach of the containment and a release of radiation which could not be prevented by the safety features.

Was the occurrence at Three Mile Island therefore a Class 9 accident?

Was the risk to health and safety and the environment 11remote in probability, 11 or 11extremely low 11 at Three Mile Island, as those terms are used in the Annex?

All parties previously requested and were granted an extension of time until Aug~st 3rd to file a response. The Staff now moves for an additional exten-sion of time until August 24, 1979 to respond to th~ Board's question (desig-nated Board Question No. 4).

The response to the Board's question is being prepared under the supervision of Dr. Roger Mattson, Director, TMI-2 Lessons Learned Task Force (Director, I

Because of Dr. Mattson's familiarity with the TMI-2 accident, the Staff believes his input and direction are very important and will be beneficial to the Board.

However, due to the pressing deadlines faced by the Lessons Learned Task Force, e.g., publica-

~\\on ~f TMI-2 *Lessons. Learned Tas.k Force Status Report and Short Term Recom-mendations, NUREG-0578, previously planned vacations of Staff members, and the complexity of Question No. 4, additional time is required to complete the response.

The Staff has conferred with all parties concerning the extension. The Licensee and LACT are prepared to file on August 3rd-, but do not object to the extension and, if granted, would file on the new date. The other parties do not object so long as the extension applies equally to them.

For the aforementioned reasons, the Staff moves for an extension of time until August 24, 1979 to respond to the Board's question.
