NOTICE OF VIOLATION Consumers Power Company Palisades Nuclear Generating Plant Docket No. 50-255 License No. DPR-20 During an NRC inspection conducted on September 12 through 30, 1994, a violation of NRC requirements was identified.

In accordance with the "General Statement of Policy and Procedure for NRC Enforcement Actions," 10 CFR Part 2, Appendix C, the violation is listed below:

10 CFR 50, Appendix B, Criteri-0n XVI, requires, in part, that measu~es shall be established to assure that conditions adverse to quality, such as failures, malfunctions, deficiencies, deviations, defective material and equipment, and nonconformances are promptly identified and corrected.

Contrary to the above, from May 1993 to September 1994; no eva 1 uat ion was performed to determine the impact on MOV operability resulting from

Contrary to the above, an evaluation of uncertainties revealed during dynamic testing of the HPSI hot leg injection valves, M0-3082 and M0-3083 conducted in January 1991 was not adequately performed until August of 1994 (50-255/94015-0lb(DRS)).

Contrary to the above, as of September 13, 1994~ corrective action was_

  • not taken to address. the act~ator overthrust condition of MOVs M0~0743, M0-0760, M0-1043A, and M0-3072.

These actuators were left in an overthrust condition after diagnostic testing was performed in 1993 (50-255/94015-0lc(DRS)).

Contrary to the above, as of September 28, 1994, corrective action was not taken after the AFW SG fOGG valve, M0~759, was overtorqued above the allowable ratings, rendering the valve inoperable (50-255/94015-0~d(DRS)).

This is a Severity Level IV violation (Supplement 1).

Pursuant to the provisions of 10 CFR 2.201, Consumer Power Company is hereby required to submit a written statement or explanation to the U.S. Nuclear Regulatory Commission, ATTN:

Document Control Desk, Washington, D.C. 20555 with a copy to the Regional Administrator, Region 111, and a copy to the NRC Resident Inspector at the facility that is the subject of this Notice, within 30 days of the date of the letter transmitting this Notice of Violation (Notice). This reply should be clearly marked a~ a "Reply to a Notic~ of Violation" and should include for each example of the violation:

(1) the reason for the violation, or, if contested, the basis for disputing the violation, (2) the corrective steps that have been taken and the results achieved, (3) the corrective steps that will be taken to avoid further violations, and (4) the date when full compliance will be achieved.

If an adequate reply is not reteived within the time specified in this Notice, an order or a Demand for Information may be issued to show cause why the license 9411100111 941104.

should not be modified, suspended~ or revoked, or why such other action as ~ay be proper should not-be taken.

Where good cause is shown, consideration will be given to extending the response time.

Under the authoiity of Section 182 of the Act, 42 U.S.C. 2232, this response shall be-submitted under oath or affirmation.
