Consumers Power Company Palisades Nuclear Generating Plant NOTICE OF VIOLATION Docket No. 50-255 License No. DPR-20 EA No.

92~214 During an NRC inspection conducted June 25-27, 1991, and a subsequent NRC investigation a violation of NRC requirements was identified.

In accordance with the "Statement of Policy and Procedure for NRC Enforcement Actions," 10 CFR Part 2, Appendix c, the violations are listed below:

Conditions No. 2.c, 2.D and 3 of Provisional Operating License No. DPR-20 authorizes the licensee, in part, to receive; possess, and use in connection with operation of the facility, byproduct, source and special nuclear materials pursuant to the Atomic.

Energy Act of 1954, as amended, and 10 CFR Parts 30, 40 and 70.

The listed authorized uses of byproduct and special nuclear materials are:

1500 curies of Polonium-210 as two sealed sources not to exceed 750 curies each; 1000 curies of Cesium.:.13_7 as multiple sealed calibration sources and up to 500 millicuries per nuclide of any byproduct material with Atomic Numbers 3-83, inclusive, without restriction to chemical and physical form to a total of 10 curies; and possess, but not separate, such byproduct and special nuclear materials as may be produced by the operation of the facility.

Contrary to the above, on November 15-16, 1990, the licensee failed to ensure that byproduct material was possessed and used in accordance with the specific purposes described in License Conditions 2.C, 2.D, or 3.

Specifically, a contractor employee placed a radioactive-"hot particle" on the back of another individual and this is not one of the uses of byproduct materials authorized by License Conditions 2.c, 2.D, or 3.

This is a Severity Level IV violation *(supplement IV).

Pursuant to the provisions of 10 CFR 2;201, Consumers Power Company (Licensee).. is hereby required to submit a written statement or explanation to the U.S. Nuclear Regulatory commission, ATTN:

Document Control Desk, Washington, D.C. ioS55 with* a copy to the Regiona*l Administrator, Region III, 799 Roosevelt Road, Glen Ellyn, Illinois 60137, and a copy to the NRC Resident Inspector at the Palisades Nuclear Generating Plant, within 30 days of the date of the letter.transmitting this Notice of Violation (Notice)..

This reply should be clearly marked-as-a "Reply to a Notice of Violation" and should include for each **_

  • violation:

(1) the reason for the violation, 'Or, if contested, the basis for disputing the violation, (2) the corrective steps that have been taken and the results achieved, (3) th~torrective steps that will be taken to avoid further violationt".and (4) the date when full compliance will be achieved.

2 order or a demand for inf orrnation may be issued as to why the license should not be modified, suspended, or revoked, or why such other action as may be proper should not be taken.

Where good cause is shown, consideration will be given to extending the response time.

Under the authority of Section 182 of the Act, 42 U.S.C. 2232, this response shall be submitted under oath or affirmation.
