PALISADES PLANT - RESPONSE TO RELIEF REQUEST CONCERNING ACTIONS 4 AND 5 OF NRC BULLETIN 88-10; NONCONFORMING MOLDED-CASE CIRCUIT BREAKERS (TAC NO. 71330)
NRC Bulletin 88-10, Nonconforming ~olded-Case Circuit Breakers, dated November 22, 1988, required a review of circuit breakers purchased prior to August 1, 1988 that were:
- 1) being mainta irled as stored spares for safety-related app l icatior1s, or
- 2) of corr.rr:ercial grade yet were beirrg maintained for future use in safety-related app l icatior1s.
Consumers Pcwcr Company responded to th~ Bulletin by letter dated March 22, 1969. This submittal. id~ntified one (1) of 132 in stock molded-case circuit breakers th~t ~~s determi~td to not be sufficiently traceable to th~ circuit brtaker manufacturer.
Following your review cf a staff letter of clarifi~ation regarding Bulletin 88-10, Ccnsumers Power Company submitted a relief request from the implementation of Action Items 4 and 5 of Bulle:tin 88-10. These Action Items, if implemente:d, would require additie;r1al assessment of all ir1stalled safety-relattd circuit breakers that WE:re procured under the same purchase order as*
the nontraceable circuit breaker.
Consumers Power Company relief request, dated June 28, 1989, summarized the trace:ability irivHtigations of the 132 molded-case circuit breakers that were in wa.rehouse stock for safety related usage when Bulletin 88-10 was received.
The circuit breakers comprised 26 different models from five mar1ufacturers, obtafot:d or1 16 different purchase orders from 1977 to 1988. The traceability investigations included: (1) order placements through all distributors, suppliers and manufacturers; (2) physical shipments and receipts from manufacturing facilities, through all distributors, distribution warehouses and suppliers to Palisades; and (3) the sources of certification and their routing to Palisades.
Mr. Gerald B.'Slade The staff has reviewed both of your responses, concentrating on the information you supplied concerning the one circuit breaker that was formally declared nontraceable. It is understood that the breaker was received on October 14, 1979, has remained in storage at Palisades since, and was pulled from stock prior to your June 28, 1989 relief rEquest. The reason you consider the breaker nontraceable is that it lacks a date code which precludes vErification of the starting point and confirmation of movements from the date of manufacture until shipment to Palisade~.
The staff has reviewed your report of th~ circumstances surrounding the one nontraceable circuit breaker. According to your report, much information is known concerning the manufacture and history of the breaker. Further, you concluded that the breaker appears genuine and unused.
The staff agrees with Consumers Power Company's determination that the existence of one nontraceable breaker ir such a large sample population (132 breakers inspected) does not indicate a breakdown of the Palisades procurement proce~s or quality assurance program.
Additionally~ it is understood that the nontraceable breaker will be disposed of. Therefore, the staff grants relief from th~ implementation cf Attio~ Items 4 and 5 cf Bulletin 88-10.
