NOTICE OF VIOLATION Consumers Power Company Docket No. 50-255 As a result of the 1nspect1on conducted during the period February 4 through March 3, 1986, and in accordance with the "General Policy and Procedures for NRC Enforcement Actions, 1110 CFR Part 2, Appendix C, (1985), the following violation was identified:
10 CFR 50.73(a) requires that a licensee submit a licensee Event Report (LER) within 30 days after the discovery of certain events specified, including: (2)(i)(B) Any operation or condition prohibited by the plant's Technical Specifications and (2)(iv) Any event or condition that resulted in manual or automatic actuation of any Engineered Safety Feature excluding those that are part of a preplanned sequence during testing or operation.
Contrary to the above, the licensee failed to submit LERs for the following:
- a.
Fire doors found open on January 6 and 8, 1986, without compensatory measures established. *Technical Specification 3.22.5 requires that all fire barriers protecting safety-related areas be functional at all times or appropriate compensatory actions, such as fire watches, be taken.
- b.
Containment isolations occurred on December 14 and 15, 1985, which were not part of a preplanned sequence.
This is a Severity Level V violation (Supplement I).
Pursuant to the provisions of 10 CFR 2.201, you are required to submit to this office within thirty days of the date of this Notice a written statement or explanation in reply, including for each violation: (1) corrective action taken and the results achieved; (2) corrective action to be taken to avoid further violations; and (3) the date when full compliance will be achieved.
Consideration may be given to extending your response time for good cause shown.
