SUBJECT:
WITHHOLDING OF INFORMATION FROM PUBLIC DISCLOSURE - PALISADES PLANT By letter dated May 14, 1980, as supported by an Exxon Nuclear Corporation, Inc., (ENC) affidavit dated April 24, 1980, you requested that information pertaining to the Cycle 4 radial peaking factor [XN-NF-80-18 (P')] be with-held from public disclosure pursuant to 10 CFR Section 2~790. Your letter dated October 22, 1981, as supported* by ENC affidavit dated September 16, 1981, requested that information with respect to the Palisades Gadolinia Demonstration Program, Cycle 4 [XN-NF-79-6l(P)] also be withheld from -
public disclosure. -In addition, you submitted nonproprietary versions of these two' documents~
Th~ reasons cited for the withholding of the doucments were that (1) the informatfon has customarily been held in confidence by.£NC and is *not avail-able in public sources, (2) it reveals certain distinguishing aspects of design and safety analysis and fuel design, and (3) the information reveals-fuel properties and operating characteristics developed by ENC.
The affidavits also* maintain that withholding of these documents secures com-petitive economic advantage to ENC for fuel man~gement and safety anal~sis optimization and improved marketabi 1 ity. Therefore, the rel ease of t.h1 s information would obviate the competitive advantage currently'realized by ENC.
We have.reviewed the applications, affidavits, and reports based on the requirements and criteria of 10 CFR 2.790(b) and have determined that the above-mentioned documents sought to be withheld contain proprietary commercial information.
We have also found at this time that the right of the pub,-ic to be fully apprised as to the bases for and effects of the proposed action does not outweigh the demonstrated concern for protection of ENC 1s competitive position. Accordingly, we have determined that the information should be
