.REGULATORY OOCKU FILE COPY The Palisades Nuclear Power Facility had been operated for an extended period of time with containment integrity violated by the locked-open condition of manual isolation valves in the containment purge bypass line.
This condition existed since the previous refueling outage in April 1978, and negated the capability of the containment building to contain an overpressure accident if such an event had occurred.
This matter was discussed with you during a meeting conducted by Mr. James G. Keppler, Director, Region III and members of his staff with representatives of Consumers Power Management on November 7,

This matter was brought to the attention of our Resident Inspector at y6ur facility in a timely fashion.
However, the prolonged violation of containment integrity is a matter of very serious safety significance.
It demonstrates a weakness in your ability to control licensed activities, specifically, your ability to control testing and ma~ntenance activities, develop and review procedures, adhere to approved procedures and conduct your audit activities.
Therefore, we propose to impose civil penalties for the items of noncompliance set forth in Appendix~ to this letter in a total amount of $450,000.00.
Appendix 8 of this letter is a Notice of Propo.sed Imposition of Civil Penalties.
You are required to respond to this letter; in preparing your response you shculd follow the instructions in Appendices A. and B.
In addition to the civil penalties, we are issuing the enclosed.Order (Appendix C) effective immediately to require that appropriate review of checklists and procedures be performed to assure that engineered safety features are in compliance with the Limiting Condition for Operation require-ments of the Technical Specifications and that monthly inspections of such features be conducted. (The requirements in Pa~t IV.B. of the Otder will be revie.1ed periodically and, based on future operating experience of the facility, may be eliminated.).*This Order further requires that you meet with the Director, Office of Inspection and Enforcement, in Bethesda, Maryland, pr~or to resumption of operation ?fter the present refueling shutdown.
