ORDER ~ODIFYING LICENSE EFFECTIVE IMMEDIATELY I.

Operating License No. DPR-20 (the 1*11 icense 11 ) which authorizes operation of the Pa 1 i sades Nuclear Power Faci 1 ity (the 11 faci1 it/

) at steady state reactor core power levels not in excess of 2530 megawatts thermal (rated power).

The license was issued on September 1, 1972.

The facility consists 6f a pressurized light water moderated and cooled reactor (PWR), located at the licensee's site in Covert Tovmship, Van Buren County, Michigan.

II.

I~ the course of a routine 1nspection conducted during September 1979, it was reported to the NRC Resident Inspector on September 14, 1979, that the facility

~ad operated with containment integrity violated by the locked-open condition cf manual isolation valves in the containment purge bypass line.

This condi-tion existed since the previous refueling outage in April 1978, at which time two manual containment isolation valves had been manipulated after testing filters and an administrative check had not been made to confirm that such valves were locked and closed as required.

Morebver, there was no evidence that the required notification and sign off had been obtained from the shift supervisor and plant health physicist.

The open valves negated the capability of the containment building to contain an overpressure accident if such an event had occurred.

The specific items of noncompliance associated with the

incident which are described in the Notice* of Violation issued this date demonstrate that the licensee has failed to adopt appropriate controls to assure that containment integrity is maintained.

This undermines the basis for c6ncluding that t~ere is now reasonable assurance that valves and other controls for engineered safety features are in their proper position.

III.

The licensee has not taken adequate action to comply with the Commission's rules, regulations and license conditions:

At present an unresolved question exists *as to whether an undue threat to the health and safety of the public

\\o.'OUld be created by resumption of facility operation.

Therefore, in view of tr.e c.bove, I have determined that the public health, safety, or interest require License No.. DPR-20 be modified as stated in Part IV be 1 ow effective i ri:medi ate iy.

IV.

Accordingly, pursuant to the Atcmic Energy Act of 1954, as amended, and the Com::-,ission's r*egulations in 10 CFR Parts 2 and 50, License No. DPR-20 is modified c.s follows:

A.

Prior to stc.rtup following the present refueling the litensee shall conduct a comprehensive review of all procedures and check lists to assure that:

(1) all valves and other controls for engineered safety features have been identified in such procedures and check lists;

B.

Report to the Director of the NRC's Region III office the results of at least monthly inspections during operation of all accessible*

valves and other contro1s for enginee~ed safety systems for compliance with the Li~iting Condition for Operation (LCO) requirements of the Technical Specifications.

C.

Prior to startup following the present refueling, the license~ shall explain to the Director, NRC Office of Inspection and Enforcement, in a meeting in Bethesdc:, Maryland, hpw the above requirements shall be implemented.
