NOTICE OF VIOLATION Tennessee Valley Authority Browns Ferry Units 2 and 3 Docket Nos. 50-260 and 50-296 License Nos..DPR-52 and DPR-68 During an NRC inspection conducted on November 15 - December 26, 1998, a violation of NRC requirements was identified.
In accordance with the "General Statement of Policy and Procedure for NRC Enforcement Action," NUREG-1600, the violation is listed below:
Technical Specification (TS) 5A.1.a requires that written procedures shall be established, implemented, and maintained covering the applicable procedures recommended in Appendix A of Regulatory Guide 1.33, Revision 2, February 1978.
Paragraph 8 ofAppendix A of Regulatory Guide 1.33 recommends procedures for performing surveillance tests.
Surveillance Procedure 2/3-SR-2, Instrument Checks and Observations, Revision 7, provides procedural guidance for implementing frequent TS surveillance requirements.
Contrary to the above, during the period of December 2 - 7, 1998, Procedure 2/3-SR-2 was not adequately established or maintained in that the licensee's methodology for calculating unidentified reactor coolant system leakage in Table 1.2 of the procedure resulted in a teak rate that was averaged over the previous 24-hour period in lieu of the required frequency of 12 hours1.388889e-4 days <br />0.00333 hours <br />1.984127e-5 weeks <br />4.566e-6 months <br />; procedural steps for performing checks on the 2-out-os voter channels of the average power range monitors were not established in plant procedures; and Procedure 2/3-SR-2 was not adequate to cover TS-required surveillance checks for reactor vessel water level narrow range instruments when the plant was in Modes 4 and 5.
This is a Severity Level IVviolation (Supplement I).
The NRC has concluded that information regarding the reason for the violation, the corrective actions taken and planned to correct the violation and prevent recurrence and the date when full compliance was achieved is already adequately addressed on the docket in the attached Inspection Report 50-259,260,296/98-09 and Licensee Event Report 50-260/1 998-004-00, dated December 31, 1998.
However, you are required to submit a written statement or explanation pursuant to 10 CFR 2.201 ifthe description therein does not accurately reflect your corrective actions or your position.
In that case, or ifyou choose to respond, clearly mark your response as a "Reply to a Notice of Violation," and send it to the U.S. Nuclear Regulatory Commission, ATTN: Document Control Desk, Washington, DC 20555 with a copy to the Regional Administrator, Region II, and a copy to the NRC Resident Inspector at the facilitythat is the subject of this Notice, within 30 days of the date of the letter transmitting this Notice of Violation (Notice).
Ifyou contest this enforcement action, you should also provide a copy of your response, with the basis for your denial, to the Director, Office of Enforcement, United States Nuclear Regulatory Commission, Washington, DC 20555-0001.
