By letter dated September 2,

1993, the Tennessee Valley Authority (TVA) requested an exemption from certain requirements of 10 CFR 73.55(d)(8) for the Browns Ferry Nuclear Plant (BFN) Units 1 and 3.

Subsequently, on September 30,

1993, TVA requested amendments to the license for BFN Units 1, 2,

and 3 to remove license conditions invoking 10 CFR 73.55(d)(8).

This regulation requires, in part, positive containment access control by a guard or watchman be maintained to ensure only authorized personnel and materials are permitted into containment during periods of frequent access.

In response to a staff request dated December 2,

1993, TVA provided additional information on December 17, 1993.

In accordance with 10 CFR 73.5, the Nuclear Regulatory Commission has granted the requested exemptions for BFN Units 1 and 3 until refueling operations commence on the respective units.

We find that granting the exemption from the requirements of 10 CFR Part 73, Section 73.55(d)(8) for containment access controls during periods of frequent access is authorized by law, will not present an undue risk to the public health and safety, and is consistent with the common defense and security.

The NRC staff finds that because the units are currently defueled, and because TVA will perform security inspections and return-to-service testing of safety-related equipment, there is high assurance that the overall level of protection against radiological sabotage will meet the overall performance requirements of 10 CFR 73.55.
