APPENDIX A NOTICE OF VIOLATION Massachusetts Institute of Technology Cambridge, Massachusetts Docket Nos.
50-20 70-938 During an NRC inspection conducted on January 14-17, 1991, violations of NRC requirements were identified.
In accordance with the "General Statement of Policy and Procedure for NRC Enforcement Actions",
(1988), the violations are listed below.

14 of NRC License No.
SNM-986 states that "The licensee
'hall conduct quarterly inspections of radiation safety activities at all work areas.
The inspection shall be conducted in accordance with a written procedure, and the findings of the inspection with needed corrective actions shall be transmitted in a timely fashion to the supervisor of the inspected area as well as the Radiation Protection Committee or the Reactor Safeguards Committee as appropriate."
Contrary to the above, the licensee had not conducted the required inspections for at least the last three years and did not have the required procedure related to the performance of these inspections nor records of transmitting inspection findings as required.
This is a Severity Level. IV Vjolation.

15 of NRC License No.
SNM-986 states that the licensee shall provide refresher training to the Health Physics Technicians every 12 months.
The records of the training shall be kept for iat least 2 years.
Contrary to the above, for at least the last three years the licensee did not perform nor document annual refresher training for health physics technicians.
This is a Severity Level IV Violation.

C.
10 CFR 20.311(b) states, in part, that the total quantity of the radionuclides H-3, C-14, Tc-99, and I-129 in a shipment must be shown on a waste shipment burial site manifest.
e Contrary to the above, the burial site waste shipment manifest for a waste shipment in December, 1990 did not contain the total quantity of the radionuclides H-3, C-14, Tc-99 and I-129 for a number of reactor spent resin packages in the shipment.
This is a Severity Level IV Violation.

We note that this is a continuing violation from a previous inspection, conducted on April 20-23,

Notice of Violation Pursuant to the provisions of 10 CFR 2.201, Massachusetts Institute of Technology is hereby required to submit a written statement or explanation to the U.S.
Nuclear Regulatory Commission, ATTN:
Document Control Desk, Washington, D.C.
20555 with a copy to the Regional Administrator, Region I, within 30 days of the date of the letter transmitting this Notice of Violation (Notice).
This reply should be clearly marked as a "Reply to a Notice of Violation" and should include for each violation:
(1) the reason for the violation, or, if contested, the basis for disputing the violation, (2) the corrective steps that have been taken and the results
- achieved, (3) the corrective steps that will be taken to avoid further violations, and (4) the date when full compliance will be achieved.
If an adequate reply is not received within the time specified in this Notice,
'n order may be issued to show cause why the license should not be modified, suspended, or revoked, or why such other action as may be proper should not be taken.
Where good cause is shown, consideration will be given to extending the response time.
