BROWNS FERRY NUCLEAR PLANT, UNITS 1, 2, AND 3 REQUEST FOR WITHHOLDING INFORMATION FROM PUBLIC DISCLOSURE (TAC NOS.
- M84161, M84162, AND H84163)
By letter dated July 23,
- 1992, as supplemented by April 6, 1993, the Tenne'ssee Valley Authority (TVA) submitted a request for amendments to licenses DPR-33, DPR-52, and DPR-68 changing the Technical Specifications for the Browns Ferry Nuclear Plant (BFN), Units 1, 2,
and 3.
In response to an NRC staff request dated February 25,
- 1993, TVA provided additional information on March 16, 1993.
The additional information letter includes an affidavit by the General Electric Company (GE) identifying part of this information as proprietary, and requests that this information be withheld from public disclosure.
The proprietary information is contained within the following GE reports:

and 3," dated November 1991.

dated March 1991.

1, "NUHAC Software Management Plan," dated March 1991.

- 23A5163, Rev.
1, "NUMAC Software Verification and Validation Plan,"
dated March 1991.
General Electric's affidavit dated March 12, 1993, stated that these reports should be considered exempt from mandatory public disclosure because the information in the documents listed above contain details of analytical
- models, methods, and processes, including computer codes and equipment, which GE has developed relative to the application of the Nuclear Measurement Analysis and Control (NUMAC) system.

Furthermore, the development of the NUHAC process, along with the interpretation and application to the boiling water reactor (BWR), is derived from the extensive BWR experience database that constitutes a major GE asset.
The information contained in the documents listed above is considered to be proprietary for the reasons set forth in the following paragraphs:

The information discloses a process, method, or apparatus, including supporting data and analyses, where prevention of its use by GE's competitors"without lic'ense from GE constitutes a competitive economic advantage over other companies;
- and, The information which, if used by a competitor, would reduce his expenditure of resources or improve his competitive position in the
- design, manufacture,'hipment, installation, assurance of quality, or'icensing of a similar product.
We have reviewed your application in accordance with the requirements of 10 CFR 2;790,
- and, on the basis of General Electric's statements, have determined that the submitted information sought to be withheld, as listed
- above, contains trade secrets or proprietary commercial information.
Therefore, the proprietary information will be withheld from public disclosure pursuant to 10 CFR 2.790(b)(5) and Section 103(b) of the Atomic Energy Act of
- 1954, as amended.
Withholding information from public disclosure shall not affect the right, if any, of persons properly and directly concerned to inspect the documents.
If the need arises, we may send copies of the information to our consultants working in this area.
We will, of course, ensure that the consultants have signed the appropriate agreements for handling proprietary information.
If the basis for withholding this information from public inspection should change in the future, such that the information could then be made available for public inspection, you should promptly notify the NRC.
You should also understand that the NRC may have cause to review this determination in the
- future, such as, if the scope of a Freedom of Information Act request includes your information. If the NRC determines that the information should be made publicly available as a result of future review, you will be notified in advance of any public disclosure.
