Dear Mr. Matos:

We have reviewed the final revisions to the Georgia regulations Chapter 391-3-17, received by our office on January 3, 2018. These regulations were reviewed by comparison to the equivalent U.S. Nuclear Regulatory Commission (NRC) rules and the requirements of Regulation Amendment Tracking System Identification Numbers (RATS IDs) 2007-3, 2012-2, 2012-4, 2015-1, 2015-2, 2015-3, 2015-4, and 2015-5 as identified in the enclosed State Regulation Status (SRS) Data Sheet. We discussed our review of the regulations with you on March 2, 2018.

As a result of our review, we have 12 comments that have been identified in the enclosure.

Please note that we have limited our review to regulations required for compatibility and/or health and safety. We have determined that if these regulations are revised, incorporating our comments and without other significant change, they would meet the compatibility and health and safety categories established in the Office of Nuclear Material Safety and Safeguards (NMSS) Procedure SA-200, Compatibility Categories and Health and Safety Identification for NRC Regulations and Other Program Elements.

We request that when you revise your regulations to address our comments, a copy of the as published regulations be provided to us for review. As requested in NMSS Procedure SA-201, Review of State Regulatory Requirements, please highlight the location of any changes made by Georgia, in response to our comments, and provide a copy to Division of Material Safety, State, Tribal, and Rulemaking Programs, NMSS. The SRS Data Sheet summarizes our knowledge of the status of other Georgia regulations, as indicated. Please let us know if you note any inaccuracies, or have any comments on the information contained in the SRS Data Sheet. Definition: Low Specific Activity GA references 10 CFR 71.15 instead of referencing its own regulation in the definition of Low Specific Activity.

The sentence should read, means radioactive material with limited specific activity which is nonfissile or is excepted under 391-3-17-.06(4)(f),

and which Additionally GA did not delete the word or before the first use of the word Uranium in 391-3.06(3)(r)1.(i).

GA needs to make the above changes in order to meet the Compatibility Category [B]

designation assigned to 10 CFR 71.4 Definition: Low Specific Activity.

Exemption for low-level materials GA omits a reference equivalent to 10 CFR Part 71 Table A-2 in 391-3-17-.06(d)(1) and (2). Paragraphs (d)(1) and 391-3-17-.06(d)(2) should contain references to Table 7 and Table 5 (A-2 and A-3 respectively).

Note: (d)(2) should reference Table 7 and 5 in two places in the sentence.

GA needs to make the above change in order to meet the Compatibility Category [B] designation assigned to 10 CFR 71.14(a)(1)-(3).

4 391-3.06(4)(f) 71.15 2015-3

[B]

Exemption from classification as fissile material GA lists an incorrect isotope in 391-3-17-.06(4)(f)6. GA needs to change plutonium-238 to plutonium-239.

GA needs to make the above change in order to meet the Compatibility Category [B] designation assigned to 10 CFR 71.15.

5 391-3.06(7) 71.17 2015-3 B

General license: NRC approved package GA needs to revise Section 391-3.06(7) so that (7)(b)4. stands alone as its own letter (e.g. (7)(b)); and further, GA needs to revise the provision to state, This general license applies only to a licensee who has a quality assurance program approved by the Georgia Department of Natural Resources, Radioactive Materials Program satisfying the provision of (22). The subsequent sections of

.06(7) should be re-lettered accordingly (e.g. (7)(c)(1)-(3), 7(d) and 7(e)).

3 STATE SECTION NRC SECTION RATS ID CATEGORY SUBJECT and COMMENTS GA needs to change.06(7)(b) to read, Each licensee issued a general license under.06(7)(a) shall -.

GA needs to remove the reference to section (8) in 391-3-17-.06(7)(d) and replace it with 10 CFR 71.19. 10 CFR 71.19 is designated as a Compatibility Category NRC, and therefore cannot have equivalent regulations in GA rules.

The previous comment in the NRC letter dated 6/15/17 stating that the general licensee should notify GA before first use of an NRC approved package, has been rescinded.

Consistent with 10 CFR 71.17(c)(3),

the licensees should submit this information to the NRC. GA needs to revise.06(7)(b)(3) to state [S]ubmit in writing before the first use of the package to: ATTN: Document Control Desk, Director, Division of Spent Fuel Storage and Transportation, Office of Nuclear Material Safety and Safeguards, using an appropriate method listed in

§ 71.1(a), the licensee's name and license number and the package identification number specified in the package approval.

GA needs to make the above changes in order to meet the Compatibility Category B designation assigned to 10 CFR 71.17.

6 391-3.06(8) 71.19 2015-3 NRC Previously Approved Package GA has an equivalent rule to 10 CFR 71.19 in 391-3-17-.06. GA needs to remove 391-3-17-.06(8) from its regulations.

GA needs to make the above change in order to meet the Compatibility Category NRC designation assigned to 10 CFR 71.19.

391-3.06(10) 71.21 2015-3 B

General license: Use of foreign approved package GA needs to change 391-3.06(10)(c)3. to read has a quality assurance program approved by the Georgia Department of Natural Resources, Radioactive Materials Program satisfying the requirements of (22).

GA needs to make the above change in order to meet the Compatibility Category B designation assigned to 10 CFR 71.21.

8 391-3.06(19) 71.91(a) 2015-3 C

Records GA omits equivalent language to 10 CFR 71.91(a)(5) and (a)(7).

GA needs to add equivalent language to their rule in order to meet the Compatibility Category C designation assigned to 10 CFR 71.91(a).

9 391-3.06(22)(f) 71.101(g) 2015-3 C

Quality assurance requirements GA needs to rewrite 391-3-17-.06(f) to read Radiography containers. A program for transport container inspection and maintenance limited to radiographic exposure devices, source changers, or packages transporting these devices and meeting the requirements of rule 391-3-17-.04(11)(d) and (e) or equivalent NRC or Agreement State requirements, is deemed to satisfy the requirements of.06(7) and.06 (22)(g).

GA needs to make the above change in order to meet the Compatibility Category C designation assigned to 10 CFR 71.101(g).

5 STATE SECTION NRC SECTION RATS ID CATEGORY SUBJECT and COMMENTS 10 391-3.06(22)(j) 71.106 2015-3 C

Changes to quality assurance program GA needs to remove all references to NRC or Agreement State and replace them with Georgia Department of Natural Resources, Radioactive Materials Program.

Additionally GA should remove references to 71.1(a) and replace with the equivalent GA requirement.

GA needs to delete the term certificate holder from 391-3.06(22)(j)(2)(a) to read: [T}he use of a quality assurance standard approved by the [insert Department]

that is more recent than the quality assurance standard in the certificate holders or applicants current quality assurance program at the time of the change; since the NRC has sole authority for issuing the certificate of compliance.

GA needs to make the above changes in order to meet the Compatibility Category C designation assigned to 10 CFR 71.106.

11 391-3.06(21) 71.97(c)(3)(ii) 2015-5 B

Advance notification of shipment of irradiated reactor fuel and nuclear waste GA lists an incorrect reference for their equivalent to 10 CFR Part 71 Table A-2 in 391-3-17-.06(21)(b)3.(ii).

The reference should be to Table 7 and not to Table 4.

GA needs to make the above change in order to meet the Compatibility Category B designation assigned to 10 CFR 71.97.
