We recently completed a review of certain applications for license amendments and other approvals which TVA filed with the Office of Nuclear Reactor Regulation (ONRR) for review in connection with the Browns Ferry Nuclear Plant, Unit Hos. 1, 2 and 3.
These applications were filed between September 1982 and December 1983.
Consequently, fee determinations ave pursuant to the provisions of 10 CFR 170.22 of Inarch 23, 1978 regulations.
The purpose of this review was to determine what fees, if any, are due the USNRC or whether any refunds are due to be made to TYA under the provisions of 10 CFR 170.
The enclosed list reflects each request, any fees paid and the ONRR staff's final fee determination and action on each.
As a result of the final review of these applications, we find that a total of $27,200 is due the NRC.
This is basically due to the fact that fees were not remitted with Items 2 through ll (Supplements 1 through 10 to Technical Specification (TS) Change Ho. 176) of the enclosed list because TVA considered these to be supplemental to the September 14, 1982 application (TS 176) since several of the proposed changes involved the same specification as TS 176 and the changes weve al'l considered to be administrative in nature.
Applications for amendments can be supplemented or superseded without additional fees being paid as long as the basic application is still pending review and as long as the supplemental data or the superseding application does not add new items to what was previously requested.
The ONRR staff have informed us that new items were included in each of the supplements.
Consequently, fees are being assessed separately for each of these supplements, except fov Item Ho. 4 on the enclosed list.
It has been-determined that Item No. 4 should be exempted from the fee oracle+

On this
- basis, we have concluded that an exemption, pursuant to 10 CFR 170.11(b),
from the fee requirements of the Ilarch 23, 1978 regulations is authorized by law and is hereby granted for the February 1, 1983 application.
In summary, TVA is requested to remit the sum of $27,200 to this office.
