APPROVAL OF STANDBY TRUST ISSUED BY BRANCH BANKING AND TRUST COMPANY, FOR BWXT GOVERNMENT GROUP, INC. AND RELEASE OF CANCELLED STANDBY TRUSTS ISSUED BY MUFG UNION, N.A. AND THE BANK OF NEW YORK (DOCKET NUMBER: 070-03085)
Dear Mr. Kubbs:
The U.S. Nuclear Regulatory Commission (NRC) staff has reviewed your proposed alternate standby trust agreement (STA), submitted by letter dated December 19, 2017 (Agencywide Documents Access and Management System (ADAMS) Accession Number ML18019A096),
and has determined that it meets applicable regulatory requirements in Title 10 to the Code of Federal Regulations Section 70.25 and is therefore approved. The newly approved STA for special nuclear material (SNM) license number SNM-2001 was established with trustee Branch Banking and Trust Company (BB&T) at the request of BWXT for BWXT Government Group, Incs, Shallow Land Disposal Area, in Parks Township, Pennsylvania, Special Nuclear Materials License SNM-2001, Docket 070-03085. The new STA replaces the previous one issued by MUFG Union Bank, N.A (MUFG). The NRCs conclusion is based on the Technical Evaluation Report: Alternate Standby Trust (enclosure 1).
As the MUFG STA has been replaced by an approved alternate STA, the NRC is hereby cancelling and releasing MUFGs STA and the associated amendment to BWXT (enclosure 2).
In addition, NRC is also returning a previously superseded STA dated July 1, 1997, issued by The Bank of New York (enclosure 3).
In accordance with10 CFR 2.390 of the NRC's "Agency Rules of Practice and Procedure," a copy of this letter will be available electronically for public inspection in the NRC Public Document Room or from the Publicly Available Records System component of the NRC's ADAMS. ADAMS is accessible from the NRC Web site at:
