DOCKET NOS. 50-400, 50-401, 50-402, and 50-403 SCHEDULE FOR COMPLETION OF CONSTRUCTION Deai Mr. Eisenhut In response to your letter of July ll, 1980 which requested an up-to-date schedule for the'ompletion of construction at the Shearon Harris Nuclear Power'lant (SHNPP), Carolina Power 6 Light Company (CP6~L) provides the following information:

Th'e 'HNPP Final Safety. Analysis Report,'nvironmental Report (Operating License Stage) and Application for Operating License were tendered'o the NRC by CP&L on June 26, 1980.

The present schedule for the SHNPP units is as follows:

March, 1985 March,'988 March," '994 March,'992 Based on previous intervention regarding the SHNPP project, we anticipate a contested public hearing at'the SHNPP Operating License St:age.'e understand that:,,pending, current rulemaking, NRC's practice is to suspend the "immediate effectiveness",rule when granting operating licenses.

Based on previous discussions with Mr. Harold Denton, we understand that a contested proceeding would likely add an additional 17 months from the date of SER issuance until the date we could expect an "effective" operating license to be'ertified.

When this 17 month interval is added to the" months required for NRC's preacceptance review and projected safety review, it is necessary for your Staff to begin at this time the'reacceptance review of the SHNPP FSAR and Environmental Report in order for a certified, effective operating license to be issued for SHNPP Unit 1 by June, 1984, the scheduled fuel load date.

Mr. Eisenhut In addition, the NRC Commissioners, in their order of April 17, 1980, directed the'NRC Staff to conduct a preliminary assessment of Carolina Power Light Company's capability to manage the operation of the

SHNPP, and to make this Staff assessment available to the public prior to publication of notice, under 10CFR2.105, regarding our application for the SHNPP operating license.

Due to the Commissioners order, we urge you to commence this preliminary assessment of CP&L's management capability immediately so that a notice of opportunity for hearing can be issued this year.

This is consistent with the Commissioners'rder of April 17, 1980, incorporating in most respects the ASLAB order of February 20, 1980 (ALAB-581).

You will recall that the ASLAB expressed the view that this additional step should not require an extended staff review period.

In order to aid your assessment of CP&L's management capability, we have under preparation additional supplementary information which is scheduled for submittal to you by September 15, 1980.

Your assistance in scheduling an expeditious review of CP&L's management capability and our tendered SHNPP FSAR and Environmental Report is appreciated.

Please contact me as soon as possible regarding your established schedule for these assessments and safety reviews.
