Transfer of Lead Responsibility Complete A Transfer of Lead Responsibility was issued from IEE to NRR on April 27, 1979

We reviewed the ICE concerns and issued a memo dated May 8, 1979 (R. Jackson, GSB to 0. Parr, DPM) requesting information from the licensee.

The licensee has responded to our requests and specific items of concern have been resolved as described in my memos to you as follows:

1980:

Emergency Service Water Intake Channel The remaining item of concern regarding fill and backfill supporting Category I pipes and conduits has been addressed by the licensee in letters dated November 6, 1979 and January 21, 1980 (M. McDuffie, CPEL to 0. Parr, NRC).

The November 6,

1979 letter.provides detailed inspection procedures to be followed for existing fill and backfill as well as. longitudinal sections showing the locations of pipes and conduits relative to existing, original and final grades.

The inspection procedures are essentially the same as thosepreviously approved for pipes and conduits in the area of Sta N 230 to N 1300.

The longitudinal sections show similar depths of fill or backfill under pipes and conduits except for localized areas where pipes and conduits are supported on as much as 18 ft of fi11.

We discussed these conditions with the licensee. and we indicated that the specified inspection procedures would not be adequate for areas of deeper fill.

The January 21, 1980 letter from the licensee provides additional inspection procedures for areas where pipes and conduits are supported on more than 10 ft of existing fill or backfill.

The procedures require testing of the deeper fill by some of, or a combination of:

a) in-place density tests in test pits.

b) density tests of undisturbed tube samples c) standard penetration testing in borings The details of the additional inspection procedures described in licensee's.

letter of January 21, 1980 are acceptable because these procedures will provide assurance that the fill is suitable for the support of Category I pipes and conduits.

We find that the items of concern identified by IRE.Region II which precipitated the transfer of. lead responsibility have been resolved.and thus we consider the transfer of lead responsibility to be complete.

We have no remaining concerns at this time and we recommend that the licensee should be permitted to continue construction in accordance with his specified procedures.

Counsel, Office of the Executive Legal Director Shearon Harris As you are no doubt aware, the Appeal Board in ALAB-577 ordered the Staff to insure that no notice of opportunity for hearing is issued on applications for operating licenses for the Shearon Harris units until:

(1)

The Staff has made a preliminary evaluation on the basis of the applications and any other information it has, of CP&L's capability to manage the operation of these units in conformity with all regulatory and other requirements of the NRC; and (2)

The Staff has made that preliminary evaluation publicly available and brought it,.with reference to the Licensing Board's and Appeal Board's decisions, to the attention of the Comnission.

Further, the notice, of opportunity for hearing is to indicate how this preliminary evaluation of the management capability can be obtained or examined.

The Appeal Board made a point of noting that the preliminary review of CP8L's management capability should be "in depth" and consider IKE's experience with operations at Brunswick and Robinson.

Although we have petitioned for review of this order, it is at present in effect.
