Dear Mr. Denton:

During the past two weeks, Carolina Power

& Light Company has participated in site meetings and telephone conversations with representatives from Region II Inspection and Enforcement and the Office of Nuclear Reactor Regulation regarding the moisture content of backfill against Category I structures and of central core material for the reservoir dams and separating dike.

As a result of these discussions, deviation notices to the Preliminary Safety Analysis Report (PSAR) are being prepared, and design change notices to construction specifications have been made.

The following changes apply to backfill against Category I structures:

PSAR Para a h 5E-2.6Backfill Criteria This paragraph will read:

"The'aterial used's backfill against Category I structures will be compacted to at least.95 percent of the maximum Standard Proctor Density.

These select backfill where hydrostatic pressure is of concern willbe residual soil of low permeability as stated in section 5E-3.1.1.1."

DCN550-259 to Ebasco S ecification CAR-SH-CH-8:

The'ollowing sentences have been added to paragraph 13.2:

. Paragraph 11.5.

Selected backfill material shall be placed ae a moisture content within + 4 percent of the optimum moisture content determined by Standard Proctor Density method.

Where selected backfill is placed around plant buildings, field permeability tests shall be performed for every 2,000 cubic yards of compacted select backfill to ensure that permeability of this fill'oes not exceed 10 feet per year.

The field permeability tests shall be performed in accordance with Bureau of Reclamation Department of Interior test procedure designated E-19 (for the fillalready in place, permeability tests at lower depths shall be performed by Bureau of Reclamation test procedure designated E-18).

The test locations shall be staggered in both horizontal directions and distributed through the depth of the backfill.

The first 24 in. or three lifts of these materials shall have a moisture content generally 1 to 2 percent greater than the optimum moisture content determined by Standard Proctor Density methods, and not more than 50 percent of the samples tested shall have moisture content between 2 and 4

percent greater than the optimum moisture content with none greater than 4

percent.

DCN 550-258 to Ebasco S ecification CAR-SH-CH-4 The following changes have been madeto paragraph 10.7:

(a)

The words "and shall have a moisture content generally 1 to 2 percent in excess of that specified in paragraph 10.5" have been deleted.

(b) A new sentence has been added after the first sentence which reads "The first 24 in. or three lifts of these materials shall have a moisture content generally 1 to 2 percent greater than the optimum moisture content determined by Standard Proctor Density methods, and not more than 50 percent of the samples tested shall have moisture content between 2 and 4 percent greater than the optimum moisture content with none greater than 4 percent."

We are continuing to evaluate your concerns regarding backfill placed against Category I structures in areas traversed by seismic Class I piping.

Backfill will not be placed in these areas until your concerns are resolved.

The resolution of this matter as well as the other issues addressed in this letter will be documented by PSAR deviation notices and be addressed in the Final Safety Analysis Report.

Carolina Power S Light Company is of the opinion, based on discussions with your staff, that these changes adequately address and alleviate the concerns of the NRC on these issues.

Please formalize'our technical concurrence with these changes so that questions asked by Region ll inspection and Enforcement can be resolved and so that construction can be authorized to proceed.
