Dear Senator Helms:

I am responding to your letter of May 26, 1999, to Dennis K. Rathbun, Director of the U.S.

Nuclear Regulatory Commission's (NRC's) Office of Congressional Affairs. In your letter, you requested that the NRC look into a situation at the Shearon Harris Nuclear Power Plant (HNP) described in a letter dated April 19, 1999, that you received from Herman Jaffe.

Mr. Jaffe raised concerns about the proposal by Carolina Power & Light Company (CP8 L), the licensee for HNP, to increase the spent fuel storage capacity at HNP. The status of the NRC's review of this issue is described below.

On December 23, 1998, CP&L submitted an amendment application to the NRC to increase its spent fuel storage capacity by placing two additional spent fuel pools in service.

On February 12, 1999, the Board of Commissioners of Orange County, North Carolina (BCOC),

requested a hearing on the application.

On May 13, 1999, the NRC's Atomic Safety and Licensing Board (ASLB), which was established to preside over the proceeding, convened a prehearing conference in Chapel Hill, North Carolina, to consider whether BCOC's request should be granted.

The ASLB's decision is pending.

'I The NRC staff's technical review of CP&L's application is ongoing. The NRC staff intends to hold a public meeting in the vicinityof HNP in the next few months to discuss the status of its technical review and to provide members of the public an opportunity to express their concerns.

Details on this meeting willbe provided to the public when they are finalized.

Mr. Jaffe also expressed concerns about HNP becoming a target for terrorist activity. The NRC staff periodically assesses the ability of licensees to respond to external threats.

From September 8 through 11, 1998, the NRC staff performed an Operational Safeguards

Response

Evaluation at HNP to assess the licensee's ability to respond to a design basis threat.

In its report of April 12, 1999, on this evaluation, the NRC staff concluded that "the protective strategy

/~01 for Harris was being effectively implemented and that the response force demonstrated excellent capabilities in protecting public health and safety against the NRC design basis threat."
