Dear Mr. Horne:
In your letter of February 3, 1999, you requested a thirty day extension of the comment period for the proposed license amendment on increasing the storage capacity for the Shearon Harris plant spent fuel pools.
The notice, which was published on January 13, 1999 at 64 Fed Reg. 2237, expired on February 12, 1999. Your request for an extension of the comment period is denied.
However, the NRC staff willaccept comments from Chatham County should you choose to provide them within a reasonable time after the Board of Commissioners has had an opportunity to evaluate your consultant's report.
Ifyou have a continuing interest in filing a petition to intervene, at the time of filing please address the requirements for late intervention found in 10 CFR g2.714.
On February 18, 1999, you spoke with Emile Julian of my staff. At that time, Mr. Julian indicated that Orange County, N.C. had filed a timely intervention petition. He promised that he would send you a copy of the Atomic Safety and Licensing Board (ASLB) establishment and the initial prehearing order of the ASLB that usually follows a Board establishment.
