REQUEST FOR EXTENSION OF COMMENT PERIOD RELATED TO PROPOSED AMENDMENTFOR SHEARON HARRIS NUCLEAR POWER

Dear Ms. Cullington:

I am responding to your letter of February 11, 1999, to the Chief of the Rules and Directives Branch of the Nuclear Regulatory Commission's (NRC's) Office of Administration. Your letter provided comments regardinl the NRC staff's proposed no significant hazards consideration determination with respect to Carolina Power 8 Light Company's (CP&L's) proposed increase in the spent fuel storage capacity at the Shearon Harris Nuclear Power Plant in Wake County, phd II (d~i

NRC needs to extend the comment period for this proposed action. As a basis for your request, you stated that the meeting schedules for Chatham and Orange Counties impaired these counties'bility to obtain an expert consultant on CP&L's proposed license amendment.

You further indicated that an extension was needed because portions of enclosure 7 of the licensee's application had been withheld from public review.

In accordance with Title 10 of the Code of Federal Re ulations (10 CFR), Section 50.91, the p

The comment period expired on February 12, 1999. The staff does not intend to extend the comment period for this notice.

However, in light of your February 11, 1999 letter, the staff willconsider any comments you may have if they are received within a reasonable time after receipt of this letter. As the enclosed letter to Mr. Charlie Horn, Chatham County Manager, indicates, the staff has also agreed to accept comments from Chatham County provided they are submitted in a reasonable time after the Board of Commissioners has had an opportunity to evaluate its consultant's report. Orange County did not request an extension of time.

With respect to the withholding of proprietary information, the staff determined, in accordance with 10 CFR Section 2.790, that certain information marked as proprietary by CP&L should be withheld from public disclosure.

Subsequent to this determination, by letter dated March 15, 1999, CP8L submitted a revised non-proprietary report to replace enclosure 7 of its December 23, 1998 submittal. The revised report was submitted to reflect a reduction in the amount of information designated as proprietary. The March 15, 1999, submittal willbe available in the local public document room; however, as you discussed with Richard Laufer of my staff during a March 18, 1999, telephone conversation, I have enclosed a copy of the non-proprietary report submitted on March 15, 1999.

Ifyou wish to review the withheld portions of CP8L's application, you may contact CP8L's counsel, Mr. Steven Carr, to discuss executing a non-disclosure agreement.
