NOTICE OF VIOLATION Carolina Power and Light Company Shearon Harris Unit 1

NPF-63 During an NRC inspection conducted on June 4 - July 1, 1994, violations of NRC requirements were identified.

In accordance with the "General Statement of Policy and Procedure for NRC Enforcement Actions,"

10 CFR Part 2, Appendix C, the violations are listed below:

A.

Technical Specification 6.8. l.a requires written procedures to be properly established and implemented covering activities referenced in Appendix A of Regulatory Guide 1.33, Revision 2, February 1978.

Regulatory Guide 1.33, Appendix A, paragraph 9.e.,

requires procedures for the control of maintenance and modification work.

B.

Procedure PLP-710, Work Management

Process, Section 4.3 and Attachment 5, require maintenance to be preplanned except for emergency situations that have an immediate and direct impact on the health and safety of the general
public, pose a significant industrial hazard or require immediate attention to prevent the deterioration of plant conditions to a possible unsafe or unstable level.

Contrary to the above, on June 29,

1994, non-emergency safety-related maintenance was performed on Emergency Service Water Strainer Backflush valve 1SW-20 without appropriate preplanning.

This is a Severity Level IV violation (Supplement I).

10 CFR 50, Appendix B, Criterion XII requires that measures be established,to assure that measuring and testing devices used in activities affecting quality be properly controlled, calibrated, and adjusted at specified periods to maintain accuracy.

The licensee's Corporate guality Assurance

Program, Section 8, establishes requirements to assure measuring and test equipment be properly controlled and calibrated.

This section specifies that portable measuring and test equipment be included in the calibration program.

Contrary to the above, on June 17,

1994, a portable high voltage probe, which was not included in the licensee's calibration program, was utilized to measure the voltage on a safety-related neutron flux monitoring system power supply during a periodic surveillance test of the instrumentation.

This is a Severity Level IV violation (Supplement I).

20555, with a copy to the Regional Administrator, Region II, and a copy to the NRC Resident Inspector at the facility that is the subject of this Notice, within 30 days of the date of the letter transmitting this Notice of Violation (Notice).

This reply should be clearly marked as a "Reply to a Notice of Violation" and should include for each violation:

(I) the reason for the violation, or, if contested, the basis for disputing the violation, (2) the corrective steps that have been taken and the results

achieved, (3) the corrective steps that will be taken to avoid further violations, and (4) the date when full compliance will be achieved.

If an adequate reply is not received within the time specified in this Notice, an order or demand for information may be issued as to why the license should not be modified, suspended, or revoked, or why such other action as may be proper should not be taken.

Where good cause is shown, consideration will be given to extending the response time.
