ENCLOSURE 1

NOTICE OF VIOLATION Carolina Power and Light Company Shearon Harris Unit 1

Docket No. 50-400 Lice'nse No. NPF-63 During an NRC inspection conducted on July 20 - August 23, 1991, violations of NRC requirements were identified.

In accordance with the "General Statement of Policy and Procedure for NRC Enforcement Actions,"

10 CFR Part 2, Appendix C

(1991), the violations are listed below:,

A.

Technical Specification 6.5.4.4 requires that audit reports shall be

prepared, approved by the Manager gA/NAD, and forwarded within 30 days after completion of the audit to the Executive Vice President, Power Supply and Senior Vice President, Nuclear Generation.

Contrary to the

above, the 1991 Fire Protection Audit, Maintenance and E&RC Audit, and the Management/Modification Audit were not approved and forwarded within 30 days after completion of the audit and the audits were not forwarded to the Executive Vice President, Power Supply, or the Senior Vice President, Nuclear Generation.

This is a Severity Level IV violation (Supplement 1).

B.

10 CFR 50 Appendix B Criterion XVIII and the licensee's accepted guality Assurance

Program, Corporate guality Assurance Program
Manual, Rev.

14, collectively require that the corrective actions for.significant conditions adverse to quality be documented.

The Corporate gA Manual, paragraph 12.4.2 further requires that if the condition is not confirmed, the initiating document shall be canceled, the basis for cancellation noted on the

document, and the document shall be placed in a permanent flle ~

Contrary to the above, maintenance and ESRC corrective actions to various adverse conditions noted during Assessment 91-02, were not properly documented.

This is a Severity Level IV violation (Supplement I).

Pursuant to the provisions of 10 CFR 2.201, Carolina Power and Light Company is hereby required to submit a written statement or explanation to the U.S.

Nuclear Regulatory Commission, ATTN:

Document Control Desk, Washington, D.C.

20555, with a copy to the Regional Administrator, Region II, and if applicable, a copy to the NRC Resident Inspector, within 30 days of the date of the letter transmitting this Notice of Violation (Notice).

This reply should be clearly marked as a "Reply to a Notice of Violation" and should include for each violation:

( 1) the reason for the violation, or, if contested, the basis for disputing the violation, (2) the corrective steps that have been taken and the results

achieved, (3) the corrective steps that will be taken to avoid further

Docket No. 50-400 License No. NPF-63 violations, and (4) the date when full compliance will be achieved.

If an adequate reply is not received within the time specified, in this Notice, an order may be issued to show cause why the license should not be modified, suspended, or revoked, or why such other action as may be proper should not be taken.

Where good cause is shown, consideration will be given to extending the response time.
