NOTICE OF VIOLATION Carolina Power and Light Company Shearon Harris Unit 1
Docket No. 50-400 License No.
NPF-63 During an NRC inspection conducted on September 15 - October 19,
- 1990, violations of NRC requirements were identified.
In accordance with the "General Statement of Policy and Procedure for NRC Enforcement Actions,"
10 CFR Part 2, Appendix C (1990), the violations are listed below:
A.
10 CFR 50.9, requires that information, required by the Commission's license conditions,to be maintained by the licensee, shall be complete and accurate in all material respects.
Contrary to the
- above, the "A" and "B" emergency battery surveillance
- test, MST-E0010, Inspection of 125 VDC Emergency Battery Banks, completed on September 26,
- 1990, and required by Technical Specification surveil-lance requirement 4.8.2. 1.a, was not accurate in all. material respects in that the times and dates documented on the surveillance for test start and completion were inaccurate and did not identify the correct times and dates when the surveillance was performed.
,This is a Severity Level IV violation (Supplement VII).
B.
Technical Specification 6.8.1.a requires that written procedures be established and implemented covering procedures outlined in Appendix A of Regulatory Guide 1.33, Revision 2, February 1978.
Regulatory Guide 1.33, Appendix A, paragraph 9, requires procedures for the conduct of maintenance activities.
Maintenance Management Manual MMM-012, Maintenance Work Control Procedure, section 5.3.3, requires that the operations shift foreman, or his
- designee, will authorize the start of work prior to craft technicians commencing work.
J Plant General Order (PGO)-53, Control of Installation and Removal of Test Equipment, Jumpers and Lifted Leads, Rules of Practice, step No. 3, allows the technician to use solely a work request only if all of the listed conditions (A-E) are met.
Condition "E" requires the installation/
removal/restoration for lifted leads to be documented on the work request.
Contrary to the above, On September 27,
- 1990, work was being performed which installed pipe supports for the component cooling water system without the prior knowledge and approval of the operations shift foreman or his designee.

On October 5,
1990 while replacing the ferro-resonant transformer and troubleshooting the uninterruptible power supply I inverter, the removal and restoration for lifted leads was not documented on the work requests.
This is a Severity Level IV violation (Supplement I).
C.
Technical Specification 3.3.3.10 and associated table 3.3-12 require, in part, that the secondary waste sample tank discharge monitor be operable.
Table 3.3-12, action 36, specifies that if the monitor is inoperable while performing a continuous
- release, then grab samples to detect radioactivity must be collected every 12 hours1.388889e-4 days <br />0.00333 hours <br />1.984127e-5 weeks <br />4.566e-6 months <br /> or every 24 hours2.777778e-4 days <br />0.00667 hours <br />3.968254e-5 weeks <br />9.132e-6 months <br />, dependent on the specific activity of the secondary coolant.
Contrary to the
- above, from approximately September 5 - September 13,
- 1990, the secondary waste sample tank discharge monitor (REM-3542) was inoperable and no grab samples were taken and analyzed for radioactivity.
This is a Severity Level 4V violation (Supplement I).

copy to the Regional Administrator, Region II, and if applicable, a copy to the NRC Resident Inspector, within 30 days of the date of the letter transmitting this Notice of Violation (Notice).
This reply should be clearly marked as a "Reply to a Notice of Violation" and should include for each violation:
( 1) the reason for the violation, or, if contested, the basis for disputing the violation, (2) the corrective steps that have been taken and the results
- achieved, (3) the corrective steps that will be taken to avoid further violations, and (4) the date when full compliance will be achieved.
If an adequate reply is not received within the time specified in this, Notice, an order may be issued to show cause why the license should not be modified, suspended, or revoked, or why such other action as may be proper should not be taken.
Where good cause is shown, consideration will be given to extending the response time.
