ENCLOSURE 1 NOTICE OF VIOLATION Carolina Power and Light Company Shearon Harris Unit 1 Docket No. 50-400 License No.
NPF-63 During the Nuclear Regulatory Commission (NRC) inspection conducted on October 7 -'ovember 17,
- 1989, a violation of NRC requirements was identified.
In accordance with the "General Statement of Policy and Procedure for NRC Enforcement Actions," 10 CFR Part 2, Appendix C (1989), the violation is listed below:
Technical Specification
- 6. 8. l. a requires that written procedures be established and implemented covering procedures outlined in Appendix A of Regulatory Guide 1.33, Revision 2, February 1978.
Regulatory Guide 1.33, Appendix A, paragraph 8.B. 1.A requires that written procedures be provided for containment leak-rate tests.
Engineering Surveillance Test EST-212, Type C
Local Leak-Rate
- Test, provides the steps necessary to perform local leak rate testing under normal operating conditions.
Contrary to the
- above, EST-212 was inadequate, in that it did not provide the necessary procedural steps or precautions to ensure the satisfactory completion of this test during abnormal plant conditions, which resulted in the injection of borated/contaminated water into the plant instrument air system.
Pursuant to the provisions of 10 CFR 2.201, Carolina Power and Light Company is hereby required to submit a written statement or explanation to the Nuclear Regulatory Commission, ATTN:

- Desk, Mashington, DC
- 20555, with a copy to the Regional Administrator, Region II, and a copy to the NRC Resident Inspector,
- Harris, within 30 days of the date of the letter transmitting this Notice.
This reply should be clearly marked as a "Reply to a Notice of Violation" and should include:
(1) admission or denial of the violation, (2) the reason for the violation if admitted, (3) the corrective steps which have been taken and the results
- achieved, (4) the corrective steps which will be taken to avoid further violations, and (5) the date when full compliance will be achieved.
