DMossburg PPAS I am pleased to respond to your letter to Mr. Denton which we received June 2, 1986, in which you expressed certain concerns about the Shearon Harris nuclear power plant.
Specifically, you requested that the NRC "not grant CPSL exemption from their full scale emergency evacuation practice before opening this plant," "
and that the NRC "keep the evacuation plan requirements at a
10 mile radius, at the very least."
The regulations do not require a that a full sca'1e emergency preparedness
>'xercise be conducted prior to plant operation of up to 5X of,rated power,.
CPItL's exemption request was that they not be required to perform a full, scale emergency preparedness prior to exceeding 5X of rated power.
By letter dated

- 1986, CPSL stated that they are now in the process of consulting wi'th '
involved off-site response organizations on the scheduling of exercises for the Shearon Harris Plant.
Furthermore, CPSL requested that the NRC st'aff hold in
abeyance active review of the exemption request and the request for a hearing until the consulting process has been completed.
At that point, CPSL will then provide additional information to the NRC staff for review.
Consequently, the NRC staff will not act on this matter until the above cited additional information has been provided.
r In response to your request that the NRC keep the evacuation radius at 10 miles, there is no plan by the NRC to reduce the present radius for the emergency plan requirements for the Shearon Harris plant, nor has there been a request by CPSL to do so.
