'F'uclear Power Plant to State of North Carolina water quality standards.

You also asked whether lack of action on these matters violates proper procedures in licensing and construction of nuclear power plants.

The specific points which you aaise relate to how State water quality standards apply to the Shearon Harris project.

Ny staff has,discussed this with Hr. Lee's staff and anticipate that his answer to your letter will be responsive and informative.

Prior to our issuance of a Construction Permit, Section 401 of the Clean Water Act requires that the utility obtain and provide to the NRC certifica-tion from the State that the project will be in compliance with State water quality standards.

Such a certification was received by NRC and was included as Appendix C of our Final Environmental Statement published in triarch 1974.

The 401 certification was revised and reissued on September 14, 1977.

On January 27, 1978, NRC issued Construction Permits for the four units.'y copy of this letter, I am requesting the State to advise us if the 401 certification is invalid and to advise NRC of any necessary action to be taken in light of the specific points which you have raised.
