REQUEST fOR WITHHOLDING IV FORMAT ION FROM PU BLIC D IS CLOSURE By your application and affidavit dated December 13, 1989, you submitted the "Plant Specific Seismic Adequacy Implementation Procedure to Resolve Unresolved Safety Issue (USI) A-46 and Generic Letter (GL) 87-02, Revision I" and requested that it be withl eld from public disclosure pursuant to 10 CFR 2.790.
You stated that the submitted information should be considered exempt from mandatory public disclosure for the following reasons:
I.
TtIe information sought to be withheld from public disclosure is owned and has been held in confidence by Florida Power and Light Company (FPL);
2.
The information is of a type customarily held in confidence by FPL and not customarily disclosed to the public; 3.
The information sought to be protected is not available in public sources; and 4.
Public disclosure of the information sought to be withheld is likely to cause substantial harm to the competitive position of FPL because the procedure was developed with FPL's resources.
The information cortained in the procedure would unduly enrich other utilities should they be able to use it without providing compensation to FPL for that use.
We have reviewed your application and the material in accordance with the requirements of 10 CFR 2.790 and, on the basis of your statements, have determined that the submitted information sought to be withheld contains proprietary commercial information.
Therefore, the "Plant Specific Seismic Adequacy Implementation Procedure to Resolve Unresolved Safety Issue (USI) A-46 and Generic Letter (GL) 87-02, Revisicn I" marked as proprietary will be withheld from public disclosure pursuant to 10 CFR 2.790(b)(5) and Section 103(b) of the Atomic Energy Act, as amended.
