Turkey Point Units 3 and 0 Docket Nos. 50-250 and 50-251 Reactor Vessel Material Surveillance Pro ram By letter dated April 30, 1986 (FPL Letter No. L-86-185) Florida Power 8c Light Company (FPL) requested an extension of the one year period specified in 10 CFR 50, Appendix H, Section Ill for submittal of the reactor vessel material surveillance specimen capsule fracture toughness test results for surveillance capsule "V"from Turkey Point Unit 3.
In response to your verbal request to identify the exact withdrawal date, capsule "V"was withdrawn from the Unit 3 reactor vessel on March 16, 1985, and not in late April 1985 as stated in our April 30, 1986 letter.
Ex vessel dosimetry, which we treat as an adjunct part of our surveillance program, was installed in April.
The date of this
-dosimetry activity was confused with the date of the surveillance capsule removal.
Therefore, the late April time frame was reported.
After 'removal, the surveillance capsule was stored in the spent fuel pool until 3une 25, 1985, at which time it was shipped to Southwest Research Inc.
for evaluation.
It is our understanding that since our April 30, 1986 request was not timely, an extension of the submittal date cannot be granted by the Director, Office 'of Nuclear Reactor Regulation, and an exemption should be requested.
Accordingly, FPL requests exemption pursuant to IO.CFR 50.12 from the one-year requirement specified in 10 CFR 50, Appendix H, Section III.
3ustification for granting the exemption is based on the following.
The delay occurred because of material circumstances beyond the control of FPL, namely, the untimely death of the SWRI project manager.
The exemption would provide'nly temporary relief from the requirements of the regulation.
FPL intends to submit the required report on or before September 1, 1986.
Application of the regulation in these particular circumstances would not serve the underlying purpose of the rule or is not necessary to achieve the underlying purpose of the rule as stated in the regulation.

Under the program, fracture toughness test data is used to establish fracture toughness requirements during system hydrostatic tests and any condition of normal operation including anticipated operational occurrences, and inservice requirements for vessel service life.
Pressure-temperature limitations for Turkey Point Units 3
and 0 are included in the Technical Specifications and are applicable for 10 effective full power years (EFPY) of operation.
As of May 3l, 1986 the cumulative EFPY for Turkey Point Unit 3 and 0 are 8.70 EFPY and 8.31 EFPY respectively.
If a change in the Technical Specifications is required based on the capsule "V" test, results, either in the pressure-temperature units, or in the operating procedures required to meet the limits, there will be sufficient time to process the change.
The schedule for submittal of the report would also allow for timely action should changes to the inservice requirements for vessel service life be required.
In accordance with 10 CFR 170.12, a check for $ 150.00 was submitted by FPL on June 13, 1986 (FPL Letter No. L-86-255).
