lie have received copies of the following applications which your Company filed with the Office of Nuclear Reactor Regulation (ONRR) for review in connection with the Donald C.
Cook Nuclear Plant Unit Nos..
1 and 2:
1.
The August 20, 1982 Technical Specification changes regarding new radiation monitors for Units 1 and 2.
Your Company stated that payment of fees for these changes will be made as part of the fees to be levied for the issuance of the NUREG-0737 Technical Speci-fications covered by other NRC reviews.
2.
A September 24, 1982 request regarding safety injection pump operability for Unit l.
A Class III fee ($4,000) was remitted with your October 15, 1982 letter for this request pursuant to 10 CFR 170.22.
3.
An October 18, 1982 request regarding Cycle 8 reload for Unit 1-Fees pursuant to 10 CFR 170.22 were not remitted with this request.
Based on information provided by the ONRR staff as the result of their preliminary andlor final reviews of the above requests. it has been determined that:

The August 20 application involved consideration of a single safety issue and a duplicate unit.
Therefore,a Class III fee ($4,000) and a Class I fee ($400) are appropriate for this application.
The application was approved by Amendment Nos.
60 and 43 issued on Sep-tember 9, 1982.
Licensees are required pursuant to 10 CFR 170 to pay fees for applications as they are filed.
This includes applications for Technical Specification changes and other requested approvals required as a result of NUREG-0737.

The September 24 application was withdrawn by letter dated October 15, 1982.
Under the provisions of 10 CFR 170.12(a),
the USNRC may retain fees for withdrawn applications.
However, the ONRR staff have informed us that no review of this application had commenced when it was with-drawn.
On this basis.
we have concluded that an exemption pursuant to 10 CFR 170.11(b) from the requirements is authorized by law and such exemption is otherwise in the public interest and is hereby granted for the September 24, 1982 application.
Therefore, a refund of $4,000 is appropriate.

The October 18 application will involve consideration of a single safety issue.
Therefore, a Glass III fee ($4,000) is appropriate for this re-quest.
Since the
$4,000 paid for Item 2 is not required, we are applying it towards the
$4,000 due for Item 3. It is requested that the sum of $4,400 which is due for Item 1
be remitted to our office. If the ONRR staff's final review of Item 3 reveals that the Glass III fee is not correct, you will be notified and any adjustments will be made.
