ENCLOSURE 1 NOTICE OF VIOLATION Arizona Public Service Company Palo Verde Nuclear Generating Station EA 98-574 Docket No.: 50-528 50-529 50-530 License No.: NPF-41 NPF-51 NPF-74 During an NRC inspection conducted from November 15 through December 26, 1998, two violations of NRC requirements were identified. In accordance with the "General Statement of Policy and Procedure for NRC Enforcement Actions," NUREG 1600, the violations are listed below:
Technical Specification 5.4.1 requires, in part, that written procedures shall be implemented covering the applicable procedures recommended in Appendix A of Regulatory Guide 1.33, Revision 2, February 1978.
Regulatory Guide 1.33, Section 2, requires that the licensee have procedures for startup, operation, and shutdown of safety-related systems, which includes the shutdown cooling system.
Procedure 40OP-9SI01, "Shutdown Cooling Initiation," Revision 9, Step 9.3.17, stated, in part, to obtain an independent verification that Valve 3JSIBHV690 was closed.
Contrary to the above, on October 21, 1998, an operator failed to obtain independent verification that Valve 3JSIBHV690 was closed while placing Train B of the shutdown cooling system in service and, as a result, the valve was left approximately 10 percent open. This is a repeat violation.
This is a Severity Level IVviolation (Supplement 1) (50-530/9809-01).
10 CFR 50.65(a)(1) requires, in part, that each holder of an operating license shall monitor the performance or condition of structures, systems, or components, against licensee-established goals, in a manner sufficient to provide reasonable assurance that such structures, systems, or components, within the scope of the Maintenance Rule, are capable of fulfillingtheir intended functions. When the performance or condition of a structure, system, or component does not meet established goals, appropriate corrective actions shall be taken.
Contrary to the above, as of July 16, 1998, the licensee failed to adequately monitor the performance or condition of the postaccident sampling system against licensee established goals, in a manner sufficient to provide reasonable assurance that the postaccident sampling system was capable of fulfillingits intended functions and, as a result, appropriate corrective actions were not taken.
This is a Severity Level IVviolation (Supplement 1) (50-528/9809-03).

The NRC has concluded that information regarding the reasons for Violations A and B, the corrective actions taken or planned to correct the violation and prevent recurrence, and the date when full compliance was or willbe achieved are already adequately addressed on the docket in the attached NRC inspection report.
For these reasons, a response to Violations A and B is not required.
However, you are required to submit a written statement or explanation, pursuant to 10 CFR 2.201, if the description herein does not accurately reflect your corrective actions or your position.
In that case, or if you choose to respond, clearly mark your response as a "Reply to a Notice of Violation," and send it to the U.S. Nuclear Regulatory Commission, ATTN:
Document Control Desk, Washington, D.C. 20555 with a copy to the Regional Administrator, Region IV, and a copy to the NRC Resident Inspector at the facilitythat is the subject of this Notice, within 30 days of the date of the letter transmitting this Notice of Violation (Notice).
Because your response, will be placed in the NRC Public Document Room (PDR), to the extent possible, it should not include any personal privacy, proprietary, or safeguards information so that it can be placed in the PDR without redaction.
If personal privacy or proprietary information is necessary to provide an acceptable response, then please provide a bracketed copy of your response that identifies the information that should be protected and a redacted copy of your response that deletes such information.
If you request withholding of such material, you must specifically identify the portions of your response that you seek to have withheld and provide in detail the bases for your claim of withholding (e.g., explain why the disclosure of information will create an unwarranted invasion of personal privacy or provide the information required by 10 CFR information). If safeguards information is necessary to provide an acceptable,
- response, please provide the level of protection described in 10 CFR 73.21.
