ENCLOSURE 1 NOTICE OF VIOLATION Arizona Public Service Company Palo Verde Nuclear Generating Station Docket No.:

NPF-74 During an NRC inspection conducted on July 12 through August 22, 1998, a violation of NRC requirements was identified. In accordance with the "General Statement of Policy and Procedure for NRC Enforcement Actions," NUREG 1600, the violation is listed below:

Technical Specification 3.5.2 states, in part, that two independent Emergency Core

. Coolirig System subsystems shall be OPERABLE with each subsystem comprised of one OPERABLE high pressure safety injection pump.

Technical Specification DEFINITION 1

~19 states, in part, that a system shall be OPERABLE or have OPERABILITYwhen it is'capable of performing its specified function and when all necessary attendant instrumentation required for the system to perform its function is also capable of performing their related support function.

With two high pressure safety injection pumps inoperable, the conditions of Technical Specification 3.0.3 are applicable since there is no associated action requirement.

Technical Specification 3,0,3 states, in part, that when a Limiting Condition for Operation is not met, except as provided in the associated ACTION requirements, within 1 hour1.157407e-5 days <br />2.777778e-4 hours <br />1.653439e-6 weeks <br />3.805e-7 months <br />, action shall be initiated to place the unit in a MODE in which the specification does not apply. Per the BASES section for Technical Specification 3.0.3, within 1 hour1.157407e-5 days <br />2.777778e-4 hours <br />1.653439e-6 weeks <br />3.805e-7 months <br />, the operator should coordinate the reduction in electrical generation with the load dispatcher to assure stability and availability of the electrical grid.

Contrary to the above, on July 30, 1998, the licensee failed to enter Technical Specification 3,0.3 at the time of its applicability and then initiate action, within 1 hour1.157407e-5 days <br />2.777778e-4 hours <br />1.653439e-6 weeks <br />3.805e-7 months <br />, to place Unit 3 in a MODE in which Technical Specification 3.5.2 did not apply, when, from approximately 6:45 a.m. to approximately 12:45 p.m., Trains A and B of the high pressure safety injection system were inoperable because the attendant instrumentation (flowtransmitters) in both trains were isolated from service and incapable of performing their related support function. Once the licensee identified this issue, prompt and effective actions were taken.

The NRC has concluded that information regarding the reasons for the above violation, the

. corrective actions taken and planned'to correct the violation and prevent recurrence, and the date when full compliance willbe achieved are already adequately addressed on the docket in Licensee Event Report 50-530/98-01.

However, you are required to submit a written statement or explanation pursuant to 10 CFR 2.201 if the description therein does not accurately reflect your corrective actions or your position.
