ENCLOSURE 1 NOTICE OF VIOLATION Arizona Public Service Company Palo Verde Nuclear Generating Station Docket No.:

NPF-51 During an NRC inspection conducted on January 27 through March 5, 1998, one violation of NRC requirements was identified.

In accordance with the "General Statement of Policy and Procedure for NRC Enforcement Actions," NUREG-1600, the violation is listed below:

Technical Specification 6.8.1 requires, in part, that written procedures shall be established, implemented, and maintained covering the applicable procedures recommended in Appendix A of Regulatory Guide 1.33, Revision 2, February 1978.

Regulatory Guide 1.33, Appendix A, Revision 2, Section 1, requires that log entries should be covered by written procedures.

Procedure 40DP-9OP22, "Operations Logkeeping," Revision 9, step 3.3.5 states, in part, "The information entered in the Control Room Log shall include... abnormal occurrences, unless previously logged and identified by an active corrective action document."

Contrary to the above, on January 22, 1998, no control room log entry was made after a significant amount of highly acidic liquid (pH 1) that posed a potential personnel hazard was identified in a concrete tench that was part of the Unit 2 sulfuric acid storage and transfer system.

The condition h'ad not been previously logged and had not been identified by an active corrective action document.

The failure to log the condition contributed to the release to the environment of a significant amount of 96 percent sulfuric acid on January 23, 1998. The licensee's performance represents a failure to carry out the important-to-safety function of maintaining complete and accurate records of significant conditions and events occurring on site.

This is a Severity Level IV violation (Supplement

1) (50-529/9811-01).

The NRC has concluded that information regarding the reason for the violation, the corrective actions taken and planned to correct the violation and prevent recurrence and the date when full

'compliance will be'achieved is already adequately addressed in your Significant Root Cause Investigation Report 2-8-033 dated February 11, 1998, and summarized in the inspection report details accompanying this Notice. However, you are required to submit a written statement or explanation pursuant to 10 CFR 2.201 ifthe description therein does not accurately reflect your corrective actions or your position.

In that case, or ifyou choose to respond, clearly mark your response as a "Reply to a Notice of Violation," and send it to the U.S. Nuclear Regulatory Commission, ATTN: Document Control Desk, Washington, D.C. 20555 with a copy to the Regional Administrator, Region IV, 611 Ryan Plaza Drive, Suite 400, Arlington, Texas 76011, and a copy to the NRC Resident Inspector at the facility that is the subject of this Notice, within 30 days of the date of the letter transmitting this Notice of Violation (Notice).
