Dear Mr. Levine:

Enclosure 1 is the draft Safety Evaluation (SE) on your proposed conversion of the current Technical Specifications (CTSs) for Palo Verde Nuclear Generating Station, Unit Nos. 1, 2, and 3, (PVNGS) to the Improved Technical Specifications (ITSs). The ITSs are based on NUREG-1432, "Standard Technical Specifications, Combustion Engineering Plants," Revision 1, dated April 1995, and on guidance provided in the Commission's "Final Policy Statement on Technical Specifications Improvements for Nuclear Power Reactors," published on July 22, 1993 (58 FR 39132). There are no open items in the draft SE.

The enclosed draft SE is based on the staffs review of your application dated October 4, 1996 (102-03794), as supplemented (1) by 19 letters in 1997 dated January 31 (102-03857),

March 16 (102-03890), May 30 (102-03942), May 30 (102-03947), June 6 (102-03954),

July 18 (102-03971), July 18 (102-03972), July 18 (102-03973), July 18 (102-03974), July 18 (102-03975), August 31 (102-04003), September 18 (102-04015), September 18 (102-04016),

September 19 (102-04018), September 19 (102-04019), November 7 (102-04036),

November 14 (102-04039), November 26 (102-04042), and December 16 (102-04052), and (2) by letter of February 12, 1998 (102-04078).

Your letter of November 14, 1997, expressed concern about a change in the NRC schedule for approving and issuing the PVNGS ITS. We responded in our letter of January 12, 1998, and the enclosed draft. SE meets the expedited schedule that we discussed in our letter.

r Included in the draft SE are the proposed changes to CTS 3/4.8.2, "Electrical Power System -

DC Sources," that you submitted in your application of December 17, 1997. These proposed changes willbe acted on by the staff, and addressed in a separate letter to you, before the PVNGS ITSs and the final SE are issued.

These proposed changes are discussed in Section III.G of the draft SE.

The enclosed draft SE is for your review to verify its accuracy and to prepare the certified ITSs for PVNGS. You are requested to provide your comments on the draft SE in writing, and a certified ITSs, by March 17, 1998. After the staff has received and reviewed your comments, it willincorporate changes, as appropriate, in the final SE before issuing the ITSs and a final SE.

You are also requested to submit a license condition for Appendix D to the licenses for PVNGS to make enforceable the transfer of those requirements in the CTSs being transferred into licensee-controlled documents (i.e., documents, such as the Updated Final Safety Analysis Report (UFSAR), for which changes to the documents by licensees are controlled by the regulations, in this case 10 CFR 50.59) for the ITS conversion, as described in your letters and the enclosed draft SE. is an acceptable license condition.

Included in the relocation of requirements from the CTS to documents outside the CTS are the relocations to be incorporated in the Quality Assurance Program (QAP) for PVNGS. The draft SE addresses these relocations in terms of details not included in your submittals, but which.

have been agreed upon with your staff. The license condition discussed above willenforce the inclusion of these details into the QAP when the ITS is approved for PVNGS.
