APPENDIX A NOTICE OF VIOLATION Arizona Public Service Company Palo Verde Nuclear Generating Station Docket:

50-529 License:

NPF-51 During an NRC inspection conducted on May 23-27,

1994, one violation of NRC requirements was identified.

In accordance with the "General Statement of Policy and Procedure for NRC Enforcement Actions,"

10 CFR Part 2, Appendix C, the violation is listed below:

Technical Specification 6.8. 1 requires, in part, that the licensee implement procedures which are required to implement the emergency plan.

Licensee's emergency plan identifies an "RCS leak rate greater than 44 gpm in Modes 5-6" as criterion for declaration of an Unusual Event.

Licensee Emergency Plan Implementing Procedure EPIP-02 establishes "RCS leak rate greater than 44 gpm (Modes 5-6)" as criterion for declaration of an Unusual Event.

Licensee Emergency Plan Implementing Procedure EPIP-02 requires that when plant conditions are such that emergency plan implementation is

required, the Shift Supervisor/Emergency Coordinator shall classify the event using the appropriate appendix as soon as possible in order to allow for prompt notification (within 15 minutes) of Offsite Authorities.

Contrary to the above, on March )2, 1994, Unit 2 experienced a Reactor Coolant System (RCS) leak rate of greater than 44 gpm in mode 5, but failed to declare an unusual event on that date and failed to notify offsite authorities until May 3, 1994.

This is a Severity Level IV violation (Supplement VIII).

During this inspection, it was determined that appropriate corrective actions had been implemented; therefore, no response to this Notice is required.
