This refers to the special
on-site inspection
conducted
by Nr. D. Schaefer of
this office on December
15-17,
1993,
and in-office review of copies of
selected
background investigation, screening files from December
27,
1993,
through January
5,
1994.
The inspection included
a review of activities
authorized for your Palo
Verde facility.
On December
17,
1993, at the
conclusion of the site visit, the inspector offered several
observations
of
your ongoing background investigation activities to Nr. Paul Caudill
and other
members of your staff identified in the enclosed
inspection report.
On
January
6,
1994,
the inspector telephonically
summarized
the preliminary
results of thi s inspection with Mr. Caudi ll, and
on January
11,
1994, Hr.
Caudi 11 discussed
the results of this inspection with Mr. R. Pate, of this
office.
This inspection
included
an examination of the circumstances
surrounding
Palo
Verde's grant of unescorted
site access
to individuals based
upon false and/or
incomplete information.
These grants of access
apparently
were caused
by
programmatic deficiencies in a contractor's
program for certification of
unescorted
access.
As a result,
Palo Verde apparently granted individuals
unescorted site access
contrary to the requirements
of 10
CFR 73.56 and your
NRC-approved Security Plan.
The inspection consisted of selective
examination
of procedures
and representative
records,
interviews with personnel,
and
observations
of activities in progress
related to the Palo Verde access
authorization
program.
Based
on the results of this inspection,
two apparent violations have
been
identified.
The first apparent violation involves the fai lure of your
contractor,
BSW Nuclear Technology
(BWNT), to provide
APS all derogatory
information developed
about applicants for unescorted
access,
and your
consequent failure to review and evaluate pertinent background information
developed
during access
authorization investigations,
before granting
individuals unescorted site access
at Palo Verde.
Consequently,
individuals
who should not have
been granted
access
obtained unescorted
access
to Palo
Verde.

The second
apparent violation involves
BWNT's failure to conduct annual
required audits of private investigative agencies
that assisted
BWNT in
conducting
background investigations.
Consequently,
BWNT for some time
performed
background investigations. using investigative information from
unaudited investigative agencies.
The first violation is being considered
for escalated
enforcement action in
accordance
with the "General
Statement of Policy and Procedure for NRC
Enforcement Actions" (Enforcement Policy),
Accordingly, no Notice of Violation is presently
being issued for these
inspection findings.
The number and characterization
of apparent violations
described
in the enclosed
inspection report
may change
as
a result of further
NRC review.
An enforcement
conference
to discuss
these
apparent violations will be
scheduled for a mutually agreeable
time in February
1994.
The purposes
of
thi s conference
are to discuss
the apparent violations, their causes
and
safety significance;
to provide you the opportunity to point out any errors in
our inspection report; to provide an opportunity for you to present your
proposed corrective acti ons;
and to discuss
any other information that wi 11
help us determine
the appropriate
enforcement
action in accordance
with the
In particular,
we expect you to address
the reasons
why
the
BWNT Letters of Certification
(Good-Guy Letters) did not include developed
derogatory information as required
by your procedure,
the reasons
your
contractor failed to conduct annual
audits of the investigative agencies
providing "completion services" for background investigations,
and the reasons
why your May 1993 audi t of BWNT did not identify the defici encies
noted during
your subsequent
audit in November
1993.
No response
regarding these
apparent
violations is required at this time.
In accordance
with 10
CFR 2.790 of the NRC's "Rules of Practice,"
a copy of
this letter
and its enclosure will be placed in the
NRC Public Document
Room.
