POINT BEACH NUCLEAR PLANT, UNIT 1AND2-ACCEPTANCE OF REQUESTED LICENSING ACTION - RE: LICENSE AMENDMENT REQUEST 287, APPLICATION TO ADOPT 10 CFR 50.69, "RISK-INFORMED CATEGORIZATION AND TREATMENT OF STRUCTURES, SYSTEM, AND COMPONENTS FOR NUCLEAR POWER PLANTS" (CAC NOS. MG0196 AND MG0197; EPID L-2017-LLA-0284)

Dear Mr. Coffey:

By letter dated August 31, 2017 (Agencywide Documents Access and Management System (ADAMS) Accession No. ML17243A201), NextEra Energy Point Beach, LLC (NextEra or licensee) submitted a license amendment request (LAR) for Point Beach Nuclear Plant (PBNP),

Unit 1 and 2. The proposed LAR would modify the licensing basis by the addition of a License Condition, to allow for the implementation of the provisions of Title 10 of the Code of Federal Regulations (1 O CFR), Part 50.69, "Risk-Informed Categorization and Treatment of Structures, Systems, and Components (SSCs) for Nuclear Power Plants."

During review of the subject LAR, in order to complete the acceptance review, supplemental information was identified by the U.S. Nuclear Regulatory Commission (NRC) staff. On October 4, 2017, this information was requested from NextEra via an email (ADAMS Accession No. ML17277B337). A follow up teleconference between NRC staff and NextEra representatives was held on October 6, 2017, during which the licensee agreed to provide the requested information by October 26, 2017. On October 23, 2017 (ADAMS Accession No. ML17292A081), NRC sent a letter to the licensee documenting this teleconference and the requested information. On October 26, 2017 (ADAMS Accession No. ML17299A012), the supplemental information was submitted by the licensee.

The purpose of this letter is to provide the results of the NRC staff's acceptance review of this LAR performed to determine if there is sufficient technical information in scope and depth to allow the NRC staff to complete its detailed technical review. The acceptance review is also intended to identify whether the application has any readily apparent information insufficiencies in its characterization of the regulatory requirements or the licensing basis of the plant.

Consistent with Section 50.90 of 10 CFR, an amendment to the license (including the technical specifications) must fully describe the changes requested, and following as far as applicable, the form prescribed for original applications. Section 50.34 of 10 CFR addresses the content of technical information required. This section stipulates that the submittal address the design and operating characteristics, unusual or novel design features, and principal safety considerations.

Coffey The NRC staff has reviewed your application and concluded that it does provide technical information in sufficient detail to enable the NRC staff to complete its detailed technical review and make an independent assessment regarding the acceptability of the proposed LAR in terms of regulatory requirements and the protection of public health and safety and the environment.

Given the lesser scope and depth of the acceptance review as compared to the detailed technical review, there may be instances in which issues that impact the NRC staff's ability to complete the detailed technical review are identified despite completion of an adequate acceptance review. If additional information is needed, you will be advised by separate correspondence.

Based on the information provided in your submittal, the NRC staff has estimated that this licensing request will take approximately 850 hours35.417 days <br />5.06 weeks <br />1.164 months <br /> to complete. The NRC staff expects to complete this review in approximately 12 months, which is August 31, 2018. If there are emergent complexities or challenges in our review that would cause changes to the initial forecasted completion date or significant changes in the forecasted hours, the reasons for the changes, along with the new estimates, will be communicated during the routine interactions with the assigned project manager.

These estimates are based on the NRC staff's initial review of the application and they could change, due to several factors including requests for additional information, unanticipated addition of scope to the review, and review by NRC advisory committees or hearing-related activities.
