APPENDIX A NOTICE OF VIOLATION Arizona Public Service Company Palo Verde Units 1 and 2

Docket Numbers 50-528 and 50-529 License Numbers NPF-41 and NPF-51 During an NRC inspeption conducted on July 15 through August 25, 1990, a

violation of NRC requirements was identified.

In accordance with the "General Statement of Policy and Procedure for NRC Enforcement Actions," 10 CFR Part 2, Appendix C (1990), the violations are listed below:

A.

Unit 1 Technical Specification 6.11.1 requires procedures for personnel radiation protection to be prepared consistent with the requirements of 10 CFR Part 20 and to be approved, maintained and adhered to for all operations involving personnel radiation exposure.

Licensee Procedure 75AC-9RP01, Radiation Exposure and Access Control, Revision 1, April 3, 1989, provides requirements for radiation workers entering radiation areas.

Step 2.5.2.1 of Procedure 75AC-9RP01 requires that "...Unit RP Operations Section is responsible for... Issuing dosimetry to individuals as specified by the Radiation Entry Permit (REP)."

REP 1-90-0010F, specifies that an alarming dosimeter with a setpoint of 50 millirem be worn in high radiation areas.

Contrary to the above, on August 14, 1990, Procedure 75AC-9RPOl was not followed in that an alarming dosimeter was issued by Unit 1 RP operations to an NRC inspector to be used for entry into a high radiation area that was not set at 50 millirem in accordance with REP 1-90-0010F.

This is a Severity Level IV violation applicable to Unit 1 (Supplement IV).

10 CFR Part 50, Appendix B, Criterion XVI, states in part that, "In the case of significant conditions adverse to quality, the measures shall assure that the cause of the condition is determined and corrective action taken to preclude repetition.

The identification of this significant condition adverse to quality, the cause of the condition, and the corrective action taken shall be documented and reported to appropriate levels of management."

Contrary to the above, from May 1989 to June 1990, conditions and parameters for some motor operated valves were identified for which the ability of the valves to function as intended under design basis conditions was not assured.

These significant conditions adverse to quality wer e not documented for engineering evaluation and the cause was not determined to preclude repetition.

The valve deficiencies were identified in Work Orders

307873, 419517, and 312013.

This is a Severity Level IV violation applicable to Units 1 and 2

(Supplement I).

Pursuant to the provisions of 10 CFR 2.201, Arizona Public Service Company is hereby required to submit a written statement or explanation to the U.

Nuclear Regulatory Commission, ATTN: Document Control Desk, Washington, DC 20555, with a copy to the Regional Administrator, Region V, and a copy to the NRC Resident Inspection office at the Palo Verde Nuclear Generating Station, within 30 days of 'the date of the letter transmittinp this Notice of Violation (Notice).

This, reply should be clearly marked as a

Reply to a Notice of Violation" and should include for Violation A: (1) the reason for the violation, or if contested, the basis for disputing the violation (2) the corrective. steps that have been taken and the results achieved; (3) the corrective steps that will be taken to avoid further violations; and (4) the date when full compliance will be achieved.

If an adequate reply is not received within the time specified in this Notice, an order may be issued to show cause why the license should not be modified, suspended, or revoked or why such other action as may be proper should not be taken.

Where good cause is shown, consideration will be given to extending your response time.
