Dear Sir:
This refers to your letter dated January 19, 1990, in response to our letter dated December 7, 1989, concerning alleged discrimination aqainst an employee for having engaged in protected activities.
Mr.
Simmons raised safety concerns to hss management and to the NRC in late 1988, and was fired in late 1989.
After reviewing the information provided and because of the circumstances of this case, we have determined that enforcement action will not be taken at this time.
No response to this letter is required.
In accordance with Section 2.790 of the,NRC's "Rules of Practice,"
Part 2, Title 10, Code of Federal Regulations, a copy of this letter will be placed in the NRC Public Document Room.
