Notification of the NRC of Employees'otential Safety Issues File:
89-056-026 The referenced letter requests licensees to examine their current and previous employee settlement agreements for discrimination matters or any labor agreements or other agreements affecting compensation,
- terms, conditions and privileges of employment to assure that clauses restricting employees or former employees from providing information to the NRC are not present.
By my letter to you dated June 20, 1989, I confirmed that Arizona Public Service Company had at that time reviewed all current and previous agreements pertaining to its current and past employees and had identified no clauses giving rise to the concerns addressed in the NRC correspondence.
In supplementation of the June 20, 1989 letter, I am now confirming that APS has contacted all known contractors, subcontractors and vendors providing goods or services to Palo Verde Nuclear Gen-erating Station for which addresses could be obtained concerning the subject matter of the NRC inquiry.
Each of the contractors, subcontractors and vendors was provided with a
copy of Victor Stello's letter to Mark DeMichele dated April 27, 1989 and a
written request for confirmation that none of their individual settlement agreements, labor agreements or any other agreement affecting compensation,
- terms, conditions and privileges of employment contained restrictions on providing safety information to the NRC or any other agency.

- contact, each of the contractors, subcontractors and vendors for which current addresses could be obtained were contacted by telephone to independently verify that they 'id not have any agreements containing language that would restrict employees or former employees from:contacting the NRC. about. safety matters.
Two contractors supplying services to Palo Verde (Bechtel Power Corporation and Volt, Inc.) have had employee labor. disputes that use broad release language in settlements that may be relevant in addressing the NRC's concerns.
Volt, Inc.'s
- employee, John
- Heneage, processed a
DOL complaint against APS which was settled utilizing broad language.
While APS does not believe the agreement encompasses restriction of contact with the
- NRC, we nonetheless have advised Mr. Heneage that the settlement agreement does not in any way prevent his bringing to the attention of the appropriate agency any information about nuclear safety.
Bechtel Power Corporation is responding directly to the Nuclear Regulatory Commission on the subject matter of this letter in a manner d'iscussing four settlement agreements that may be responsive to Victor Stello's letter of April 27, 1989.
Bechtel has informed APS that none of those Bechtel agreements pertain to employees at Palo Verde Nuclear Generating Station.
APS has not received any indication that any other of its con-tractors, subcontractors or vendors has entered into any settlement or labor agreements or any other agreement affecting compensation,
- terms, conditions and privileges of employment, that contain restrictions on providing safety information to the Nuclear Regulatory Commission or any other agency.
