Thank you for your letter of November 21,
1989, in response
to our Notice of
Violation and Inspection
Report
Nos.
50-528/89-36,
50-529/89-36
and
50-530/89-36,
dated October 25,
1989, informing us of the steps
you have taken
to correct the items which we brought to your attention.
Your'orrective
actions
wi 11
be verified during a future inspection.
Based
on our review of the information you provided to support the
position denying violation 50-528/89-36-01,
we have concluded that the
violation was valid.
Your response
agreed that open, valve V004 created
the
gravity drain path which allowed the event to occur.
Additionally, your
response
stated that valve V004 was intentionally not placed
on the valve
lineup,
was not part of the desired flow path,
and thus
was intentionally left
open.
However,
as noted in the citation, your Unit 1 Night Order of Nay 25,
1989 required that
"Mhen any evolution is-planned,
sufficient valves which
encompass
the desired flow path, must be actually verified to ensure that the
water flows only from/through/to the desired portions of the system."
Since
open valve V004 provided
a flow path through which water
may flow other than
"from/through/to 'he desired portions of the system,
then it follows from the
Night Order that this alternate potential flow path was required to have
been
eliminated by verifying a valve in this path
(V004) actually shut.
Your assertion
that the operators
intentionally left V004 open further adds to
our concern that the operators
apparently did not fully appreciate
the
significance of alternate potential flow paths,
which was partly the cause of
the previous event in Unit 3 as noted in the citation,
and which the Unit j.
Night Order was specifically written to avoid.
In fact, you noted from your
own analysis of this event that the Shift Supervisor
and his assistant
failed
to adequately
consider all potential gravity drain paths prior to the
evolution.
Furthermore,
your described corrective action emphasized verification of the
desired position of all valves in branch paths
as well as the desired flow
path.
Thus,
we conclude that the meaning
and intent of the Night Order,
within the context of its use
as implementation of corrective action following
the Unit 3 incident,
should
have prompted operator action to identify and

isolate the inadvertent flow path which caused
the Unit 1 problem.
Accordingly, withdrawal of the violation is unwarranted.
