APPENDIX A NOTICE OF VIOLATION Arizona Publ ic Servi ce Company Palo Verde Nuclear Generating Station Units 1 and 2

Docket Nos.

50-528, 50-529 License Nos.

NPF-41, NPF-51 During an NRC inspection conducted July 13-17 and August 3-6, 1987, violations of NRC requirements were identified.

In accordance with the "General Statement of Policy and Procedure. for NRC Enforcement Actions," 10 CFR Part 2, Appendix C (1987), the violations are listed below:

A.

Unit 1 Technical Specification,

6. 12, Hi h Radiation Area, requires, in part, in
6. 12. 1 that, "...Any individual...permitted to enter such areas shall be provided with or accompanied by one or more of the following:

"a.

A radiation monitoring device which continuously indicates the radiation dose rate in the area.

"b.

A radiation monitoring device which continuously integrates the radiation dose rate in the area and alarms when a preset integrated dose is received....

c.

A radiation protection qualified individual (i.e., qualified in radiation protection procedures) with a radiation dose rate monitoring device...."

Contrary to the above, on June 30, 1987, a worker, not equipped or accompanied as specified above, entered the Unit 1, LPSI "B" pump room, a

posted high radiation area.

This is a Severity Level-IV Violation (Supplement IV).

B.

Unit 2 Technical Specification, 3.3.3.9, Radioactive Gaseous Effluent Monitorin Instrumentation, requires that the, "... instrumentation channels shown in Table 3.3-13 shall be OPERABLE...."

Action b. of the Specification requires that, "With less than the minimum number of...channels

OPERABLE, take the ACTION shown in Table 3.3-13."

Table 3.3-13, item 5,-Fuel Building Ventilation System, A.

Low Range Monitors, e.

Sampler Flow Rate Measuring Device, identifies Action 36.

Action 36 requires that the flow rate be, "...estimated at least once per 4 hours4.62963e-5 days <br />0.00111 hours <br />6.613757e-6 weeks <br />1.522e-6 months <br />."

Contrary to the above, during use o'f the preplanned alternate sampler for Unit 2 monitor RU-145, the flow rate was not estimated or verified once per 4 hours4.62963e-5 days <br />0.00111 hours <br />6.613757e-6 weeks <br />1.522e-6 months <br /> at 0030 on May 30 and 0410 on May 31, 1987.

This is a Severity Level IV Violation (Supplement VII).

With respect to Item A, pursuant to the provisions of 10 CFR 2.201, Arizona Public Service Company is hereby required to submit a written statement or explanation to the U.

S. Nuclear Regulatory Commission, ATTN:

Document Control Desk, Washington, DC 20555 with a copy to the Regional Administrator, Region V, within 30 days of the date of the letter transmitting this Notice.

This reply should be clearly marked as a "Reply to a Notice of Violation" and should include for each violation:

(1) the reason for the violation if

admitted, (2) the corrective steps that have been taken and the results
achieved, (3) the corrective steps that will be taken to avoid further violations, and (4) the date when full compliance will be achieved.

If an adequate reply is not received within the time specified in this Notice, an order may be issued to show cause why the license should not be modified, suspended or revoked or why such other action as may be proper should not be taken.

Consideration may be given to extending the response time for good cause shown.

With respect to Item B, pursuant to the provisions of 10 CFR 2.201, no response is necessary in view of the timely manner in which you corrected the

item, and your actions to preclude recurrence of similar violations.
