Dear Mr. Knighton:

In the referenced letter, ANPP requested a schedular exemption to the requirements of 10 CFR 50.71(e).

The special circumstances, under which this request for an exemption has been

sought, correspond to items 2(i) and 2(ii) of 10 CFR 50. 12 speci-fic exemptions'n October 1,
1979, ANPP submitted the Final Safety Analysis Report (FSAR) for all three Palo Verde Units.

From that time until the present, the staff has reviewed the FSAR on the basis that it was for all three units;

however, since all three units are not being licensed at the same time, there are two regulations which come in conflict with each other.

10 CFR 50'4 requires ANPP to amend the FSAR in order to keep the information contained therein current, whereas 10 CFR 50.71(e) requires ANPP to submit an entirely new document, an Updated Safety Analysis Report (USAR), which replaces the existing FSAR ~ Therefore, in order to comply with these two regulations concurrently ANPP would have to maintain both the FSAR with amend-ments and the USAR. Maintaining two versions of the same licensing document for all three units would be difficult, could lead to ambiguities and confusion and would serve no useful purpose if the existing FSAR is maintained, up-to-date through the licensing of Unit 3 ~

In order to eliminate the conflict in the implementation of these two regulations, ANPP proposed a plan in the referenced letter, which was to transmit the USAR one year following the issuance of the Unit 3 license.

This proposal meets the intent of the regulations without raising any safety concerns'NPP will still maintain a Safety Analysis Report For all three units with current information and the infor-mation will be transmitted to the staff on a timely basis.

time, ANPP plans to submit Amendment 15 to the FSAR during the first part of May. Therefore, due to the work in progress, your prompt attention to this matter would be greatly appreciated.
