Dear Mr. Knighton:

Reference (A), as provided by 10CFR 50.12(a), requested a partial exemption from the provisions of General Design Criterion 4 (GDC-4) for PVNGS Units 1, 2, and

3. Specifically, reference (A) requested exemption from those portions of GDC-4 which require protection of structures, systems, and components against certain dynamic effects associated with postulated Reactor Coolant System (RCS) main loop pipe breaks. Subsequent to the submittal of reference (A), ANPP was informally advised by the NRC that the Exemption Request would be denied for Unit 1, and that for Units 2 and 3, the matter should be presented through the process of amendment of construction permits rather than through the exemption process.

Reference (B) provided the application for Amendments of Construction Permits CPPR-142 and CPR-143, PVNGS Units 2 and 3, respectively. This application sought authorization to modify Units 2 and 3 by deleting protective devices, which were required to guard against dynamic effects of postulated double-ended guillotine breaks in the RCS main loop piping. Recently, ANPP was 'informally advised by the NRC that exemption from the regulations cannot be granted on this matter for the life of the units. Further, to allow processing of the application to amend the construction permits, a schedular exemption request from the requirements of GDC-4, until the end of the second refueling outage, would be needed. This schedular exemption should be sufficient to allow the completion of the rulemaking process on this subject.

As provided by 10CFR 50.12(a), Arizona Public Service Company hereby requests for PVNGS Units 2 and 3, a partial exemption from 'the provisions of GDC-4, as requested and justified in reference (A), for a period ending with the completion of the second .

refueling outage of each unit.

Also, Arizona Public Service Company hereby requests that construction permits, CPPR-142 and CPPR-143, be amended to permit the implementation of the exemption upon its issuance.
