This refers to your letter of December 26, 1984 which responded to an NRC letter and Item I.B of the Notice of Violation and Proposed Imposition of Civil Penalties of December 12, 1983.

That item involved an apparent falsification of records related to electrical terminations and was addressed in a special inspection report sent to you on April 22, 1983.

A subsequent report of an investigation of the matter prepared by the NRC Office of Investigations was sent to you on November 21, 1984.

We have carefully considered your response in which you admit that the violation occurred as stated in Item I.B. of the Notice and your request for

'emission of the proposed civil penalty.

The information that you provided as grounds for remission was fully considered at the time the civil penalty was proposed for that violation.

Therefore, since no new information has been presented or otherwise discovered, we have concluded for the reasons given in the enclosed Order and Appendix that neither the requested remission nor mitigation is warranted.

Accordingly, we hereby serve the enclosed Order on Arizona Public Service Company imposing a civil penalty in the amount of Forty Thousand Dollars ($40,000).

In accordance with 2.790 of the NRC's "Rules of Practice,"

Part 2, Title 10, Code of Federal Regulations, a copy of this letter and the enclosures will be placed in the NRC's Public Document Room.
